In lieu of personal service or service by affixation, the Notice of Infraction may be mailed by regular mail to the owner and/or operator of the vehicle where the operator of the vehicle successfully resists affixation and immediate personal service of the Notice of Infraction, and such service has the same force and effect and is subject to the same penalties for the disregard thereof as if the Notice of Infraction were personally served upon the owner and/or operator of the vehicle.
(B) For the purposes of this Chapter, an operator of a vehicle who is not the owner thereof but who uses or operates the vehicle with the permission of the owner, express or implied, is deemed to be the agent of the owner to receive a Notice of Infraction, whether it is personally served on the operator or served by affixation, and service made in either manner is also deemed to be lawful service upon the owner.
