Las Vegas Municipal Code § 11.10.010 Violation—Infraction—Handicapped parking—Definitions.

11.10.010 - Violation—Infraction—Handicapped parking—Definitions. (A) It is a civil infraction, for which both the registered owner and the operator of a vehicle are liable, for such vehicle to be parked or found in violation of any of the parking laws which are set forth in this Title. (B) Nothing in this Title shall prohibit the parking of a vehicle, consistent with public safety, by a physically handicapped person, a disabled veteran or a person transporting a physically handicapped person or disabled veteran in compliance with NRS 484B.463. (C) For purposes of the provisions of this Title that pertain to the parking, stopping, standing or loading of vehicles, unless otherwise indicated: (1) "Operator" means and includes every individual who operates a vehicle as the owner thereof, or as the agent, employee or permittee of the owner, or is in actual physical control of a vehicle. (2) "Park" or "parking" means the standing, stopping or halting of a vehicle, whether occupied or not, upon a street, including temporarily for the purpose of, and while engaged in, receiving or discharging passengers or loading or unloading freight, cargo, merchandise or other goods, but not including in obedience to traffic regulations, signs or signals or an involuntary stopping of the vehicle by reason of causes beyond the control of the operator of the vehicle. (3) "Parking meter" means and includes any mechanical device or meter not inconsistent with this Title placed or erected for the regulation of parking by authority of this Title. (4) "Parking meter space" means any space within a parking meter zone that is assigned to or governed by a parking meter, duly designated for the parking of a single vehicle, and marked as such by painted lines or other durable markings on the curb, street surface, or other location for the space. (5) "Parking meter zone" includes any street or City parking facility upon or in which parking meters are installed and in operation. (6) "Registered owner" means a person whose name appears in the records of the Nevada Department of Motor Vehicles as the person to whom a vehicle is registered. (7) "Street" means any public street, avenue, road, alley, highway, lane, path or other public place located in the City and established for the conveyance of vehicular traffic. (8) "Vehicle" means any device in, upon or by which any person or property is or may be transported upon a highway, except a device which is operated upon rails or tracks. (D) For purposes of this Chapter: (1) "Level 1 appeal" means the initial process for appealing a Notice of Infraction under this Chapter, as described in LVMC 11.10.080. (2) "Level 2 appeal" means the process for further appealing the decision made in a Level 1 appeal, as described in LVMC 11.10.100. (3) "Parking Services Division" means the Parking Services Division of the Department of Economic and Urban Development. Las Vegas Municipal Code § 11.10.020 Violation—Notice of Infraction.

11.10.020 - Violation—Notice of Infraction. Whenever any vehicle is found in violation of the parking laws which are set forth in this Title, a Notice of Infraction may be issued in accordance with this Chapter. (Ord. 5870 § 5, 2006: Ord. 3829 § 1 (part), 1994)

Las Vegas Municipal Code § 11.10.030 Notice of Infraction—Contents.

11.10.030 - Notice of Infraction—Contents. (A) A Notice of Infraction issued under this Chapter must contain the following information: (1) The state and license number and the make of the vehicle which is parked in violation of the provisions of this Code; (2) The location at which the violation occurred; (3) The date and time of the violation; (4) The location and number of the parking space, if the vehicle is violating a parking regulation respecting the use of parking meters, as provided for in Chapter 11.54; (5) The name of the person who issues the Notice of Infraction; (6) The section of this Code which allegedly is being violated; (7) Information which advises of the manner in which, and the time within which, the Notice of Infraction must be answered; (8) Such other information as the Parking Services Division may prescribe. (B) No error concerning or omission of any of the above-described information is grounds for the dismissal of an action relating to a Notice of Infraction unless the person requesting such a disposition demonstrates substantial prejudice therefrom by a preponderance of the evidence. (C) Where the Notice of Infraction data is entered into and stored in a computer or similar device, any printout or other output readable by sight which accurately reflects such data is an "original" Notice of Infraction for purposes of this Chapter. Any such recording which is moved or copied into another computer or similar device and is intended to have the same effect by the issuing officer is also an "original" Notice of Infraction for purposes of this Chapter. (D) Any Notice of Infraction issued pursuant to this Chapter, shall constitute a declaration which is subject to the penalty of perjury. (Ord. No. 6437, § 2, 8-5-15; Ord. No. 6326, § 7, 6-18-14; Ord. Las Vegas Municipal Code § 11.10.040 Notice of Infraction—Issuance.

Las Vegas Municipal Code § 11.10.050 Notice of Infraction—Filing.

11.10.050 - Notice of Infraction—Filing. An original Notice of Infraction, or a facsimile thereof, must be filed with and retained by the Parking Services Division of the Department of Economic and Urban Development and is deemed to be a public record of matters which are observed pursuant to a duty which is imposed by law and is prima facie evidence of the facts which are alleged therein. An original or duplicate of the Notice of Infraction must be served on the person to whom it is issued as provided in Section 11.10.060. (Ord. Las Vegas Municipal Code § 11.10.060 Notice of Infraction—Service.

11.10.060 - Notice of Infraction—Service. (A) The Notice of Infraction must be served upon the owner and/or operator of the vehicle by affixing the Notice to the vehicle in a conspicuous place. Service of the Notice of Infraction by affixation has the same force and effect and is subject to the same penalties for the disregard thereof as if the Notice of Infraction were personally served on the owner and/or operator of the vehicle. In lieu of service by affixation the Notice of Infraction may be personally served upon the owner and/or operator of the vehicle. In lieu of personal service or service by affixation, the Notice of Infraction may be mailed by regular mail to the owner and/or operator of the vehicle where the operator of the vehicle successfully resists affixation and immediate personal service of the Notice of Infraction, and such service has the same force and effect and is subject to the same penalties for the disregard thereof as if the Notice of Infraction were personally served upon the owner and/or operator of the vehicle. (B) For the purposes of this Chapter, an operator of a vehicle who is not the owner thereof but who uses or operates the vehicle with the permission of the owner, express or implied, is deemed to be the agent of the owner to receive a Notice of Infraction, whether it is personally served on the operator or served by affixation, and service made in either manner is also deemed to be lawful service upon the owner. Las Vegas Municipal Code § 11.10.070 Liability—Leased or rented vehicles.

11.10.070 - Liability—Leased or rented vehicles. (A) The operator of a vehicle is liable for the civil fines and civil penalties which are imposed pursuant to this Chapter. The registered owner of the vehicle, even if not the operator thereof, is also liable for such civil fines and civil penalties unless the owner is able to demonstrate that the vehicle was used without permission, express or implied. A registered owner who pays any civil fine and/or civil penalty pursuant to this Chapter has the right to recover from the operator of the vehicle the civil fine and/or civil penalty so paid and has a cause of action in any court which has appropriate jurisdiction against the operator of the vehicle for the amount so paid. (B) In order to hold the operator of a leased or rented vehicle primarily responsible for the issuance of the Notice of Infraction, the name, address and phone number of the person renting or leasing a vehicle found parked in violation of this Title must be provided by the rental or leasing agent or agency to the Parking Services Division within thirty calendar days of receiving notice of such infraction. Nothing in this provision shall absolve the owner of responsibility for the issuance of the Notice of Infraction as provided in this Chapter. (Ord. Las Vegas Municipal Code § 11.10.080 Notice of Infraction—Duties of respondent—Appeal.

11.10.080 - Notice of Infraction—Duties of respondent—Appeal. (A) The owner or operator of a vehicle concerning which a Notice of Infraction has been issued and served in accordance with this Chapter must do one of the following: (1) "Admit" responsibility for the commission of the infraction and liability for the penalty imposed and pay the appropriate civil fine and penalty; (2) Contact the Parking Services Division, "admit" responsibility and liability for the commission of the infraction and any penalties thereon and arrange a schedule for the payment of such fines and penalties; or (3) Appeal the Notice of Infraction, as provided for in Subsections (B) to (E), inclusive, of this Section in order to disclaim responsibility as the owner or operator, or to dispute the propriety of the issuance of the Notice of Infraction and any penalties related thereto. →The time periods within which such actions must be taken are set forth in LVMC 11.10.090. (B) A person may initiate an appeal pursuant to Paragraph (3) of Subsection (A) of this Section (a Level 1 appeal) by submitting an appeal to the Parking Services Division. The appeal shall be submitted on a form provided by the Parking Services Division, which form shall require the person initiating the appeal (the "Level 1 appellant") to indicate, among other things, his or her name, current address, a reference to the Notice of Infraction appealed from and the associated penalties, and the grounds for appeal. (C) The Level 1 appeal shall be decided administratively by the Parking Services Division based on a review of the Notice of Infraction, the circumstances surrounding its issuance, and any grounds or evidence provided by the appellant. The Parking Services Division may decide in favor of the Level 1 appellant by finding no liability, may find liability but impose a fine in an amount less than that set forth in this Title, or may waive late fees and penalties for any one or more of the following reasons: (1) The owner of the vehicle is able to demonstrate that the vehicle had been stolen or was displaying stolen license plates at the time it was parked; (2) In connection with an alleged violation of an ordinance pertaining to a meter, the meter was mechanically malfunctioning to the extent that its reliability was questionable; (3) Compliance with the ordinance provision alleged to have been violated would have presented an imminent danger to persons or property; (4) The area of the alleged violation was so inadequately marked or lit as to fail to give sufficient notice that access to the area was restricted or prohibited; (5) A mechanical malfunction of the vehicle caused it to be parked in the area alleged and it was removed as soon as could be reasonably expected thereafter; (6) At the time of the issuance of the Notice of Infraction, the vehicle was parked consistent with and in compliance with NRS 484B.463 pertaining to persons with a disability or handicap; (7) The Level 1 appellant establishes by a preponderance of the evidence that, through no fault of himself or his agent, he or she failed to receive notice of the issuance of the Notice of Infraction as provided in this Chapter; (8) The operator of the vehicle experienced a medical or other emergency; (9) The Notice of Infraction was issued in error; (10) The violation relates to the parking of a law enforcement vehicle while on official business; (11) The existence of unclear transfer of ownership of a vehicle; (12) Bankruptcy or death of an owner; (13) Payment was made for the wrong parking space; (14) The vehicle in question was registered even though the current registration was not displayed; (15) The vehicle in question was eligible to park in a handicapped space even though placard not displayed; (16) The vehicle in question was ineligible to park in a handicap access aisle but was eligible to park in a handicap space; or (17) Financial hardship—living below federally designated poverty level. (D) Notwithstanding any other provision of this Chapter, the Parking Services Division has the discretion, but is under no obligation, to decide in favor of a particular appellant by finding no liability, finding liability but imposing a fine less than that set forth in this Title, waiving late fees and penalties otherwise accruing, or converting a Notice of Infraction to a warning upon a determination that, considering all the circumstances, unfairness would otherwise result. Examples include the issuance of a Notice of Infraction: (1) Under circumstances or in a manner contrary to one or more policies duly adopted by the Parking Services Division; or (2) At a location concerning which motorists have been mistakenly led to believe that parking at that location and time is not subject to the parking restrictions otherwise in force. →Any disposition under the authority of this Subsection (D) must be properly documented. (E) Notice of the decision made by the Parking Services Division in connection with a Level 1 appeal shall be provided to the Level 1 appellant by: (1) Mailing such notice to the appellant at the address provided by the Level 1 appellant; (2) Mailing such notice to the address of the Level 1 appellant on file with the Nevada Department of Motor Vehicles; or (3) Sending such notice to the Level 1 appellant by electronic mail, if such appellant has requested communication by means of electronic mail. (F) Within thirty days after notice of a decision has been provided pursuant to Subsection (E) of this Section, the Level 1 appellant must: (1) Pay or cause to be paid in full all fines and penalties remaining to be paid regarding the Notice of Violation; (2) Make arrangements with the City regarding a schedule for the payment of such fines and penalties; or (3) Request an appeal hearing (a Level 2 appeal) in accordance with LVMC 11.10.100. Las Vegas Municipal Code § 11.10.090 Notice of Infraction—Response—Supplementary notice.

11.10.090 - Notice of Infraction—Response—Supplementary notice. (A) Subject to the provisions of Subsection (C), a response to a Notice of Infraction that is intended to admit liability, in accordance with LVMC 11.10.080(A)(1) or 11.10.080(A)(2), must be made within thirty calendar days after the date on which the Notice of Infraction is served. If no response is received during such thirty-day period, the Notice of Infraction is subject to an additional civil penalty as set forth in the schedule of fines and penalties, identified under the heading "Late 1." (B) After the expiration of the thirty-day response period described in Subsection (A), the Parking Services Division must send a Notice of Delinquency by regular mail to the registered owner of the vehicle at the registered owner's last known address, as indicated by the vehicle registration which is maintained by the Nevada Department of Motor Vehicles. The Notice of Delinquency must contain the date of the infraction, the amount of the civil fine and the amount of any penalty which is associated therewith. The registered owner will have fifteen calendar days after the date of the Notice of Delinquency in which to respond thereto in the manner which is provided in LVMC 11.10.080. If no response is made to the Notice of Delinquency within such additional fifteen-day period, an additional civil penalty will be assessed in an amount set forth in the schedule of fines and penalties, identified under the heading "Late 2". (C) A person who wishes to appeal a Notice of Infraction in accordance with LVMC 11.10.080(A)(3) must do so within ninety calendar days after the date on which the Notice is served. To the extent the appeal is filed after any of the response periods set forth in Subsections (A) and (B) of this Section, the additional civil penalties shall attach to the Notice of Infraction and the appeal will include those penalties in addition to the amount of the initial civil fine. (D) In addition to and independent of any notice required by this Chapter, the Parking Services Division is authorized to provide supplementary notice of the existence of and duties regarding a Notice of Infraction, including without limitation an additional notice fourteen days after the issuance and service of a Notice of Infraction. Such supplementary notice is provided as a courtesy only, and any failure or irregularity regarding such supplementary notice provides no defense or recourse under this Chapter. (E) If a person fails to respond to a Notice of Infraction or a Notice of Delinquency in accordance with this Chapter, the City is entitled to collect the amount of any fines and penalties by means of any remedy available under applicable law, including without limitation filing a notice of nonpayment with the Nevada Department of Motor Vehicles and referring the matter to a collection agency. Las Vegas Municipal Code § 11.10.100 Level 2 appeals.

11.10.100 - Level 2 appeals. (A) A Level 2 appeal referred to in Paragraph (3) of Subsection (F) of LVMC 11.10.080 is initiated by: (1) Contacting the offices of the Parking Services Division within the thirty-day period referred to; (2) Requesting a Level 2 appeal hearing; and (3) Receiving a date for hearing the appeal. (B) A Level 2 appeal may be filed by or on behalf of the registered owner of the vehicle that is subject of the Notice of Infraction. (C) A person requesting a Level 2 hearing (a "Level 2 appellant") shall provide such information as the Parking Services Division may require. A Level 2 hearing shall be conducted by a Hearing Officer provided for by the City. A Level 2 appellant shall be bound by the decision of the Hearing Officer concerning liability for the infraction(s) and responsibility for the penalties thereon. It is expected that a Level 2 appellant will appear in person or by representative at a Level 2 hearing. However, at the Hearing Officer's discretion, a hearing may be held and the appeal decided without an appearance by the Level 2 appellant. If any Level 2 appellant scheduling a hearing before the Hearing Officer fails to appear at such hearing without having first sought and obtained a continuance of such hearing, the Hearing Officer may (but is not required to) enter a decision against the appellant for the full amount of fines and penalties scheduled to be reviewed. In connection with the request for a hearing, the Level 2 appellant must acknowledge the binding nature of the hearing and the Hearing Officer's authority in the event the appellant fails to appear at a hearing. The acknowledgment shall be in substantially the following form: I ___________, hereby request a binding hearing before the Hearing Officer. My address is ___________. I request that this hearing involve Notice(s) of Infraction(s) Number ___________. I understand that the Hearing Officer is an attorney and not an elected or appointed judge. I understand that I am bound by the decision of the Hearing Officer. I understand that I am expected to appear in person or by representative at the requested hearing, but that the hearing may be held and the appeal decided without such appearance. I understand that if I fail to appear for the scheduled hearing before the Hearing Officer without first obtaining a continuance of such hearing, the Hearing Officer may (but is not required to) enter a decision against me for the full amount and penalties scheduled to be reviewed. I understand and agree that if necessary due to my lack of timely payment, the City of Las Vegas can and will use this binding decision to have a formal civil judgment entered against me in the Las Vegas Municipal Court. I understand that if a civil judgment is obtained, the City may seek and obtain a writ of execution against me. I understand that if a writ of execution is obtained, my wages and/or bank accounts may be garnished, liens may be put on my property and my vehicle(s) may be towed or immobilized. I also understand that my vehicle(s) may be immobilized without a writ of execution if: 1. I accumulate more than $200.00 in unpaid civil fines, judgments and penalties for parking violations; and 2. At least two Notices of Infraction have been issued and served with respect to vehicles registered to me and have not been responded to within the time set forth in LVMC 11.10.090. Knowing all of the above, I still wish to request a binding hearing before the Hearing Officer on the above-described Notice(s) of Infraction(s). I hereby acknowledge the above and further acknowledge that at my request a hearing has been set for _______, 20___ at the hour of ___m. ___________ Appellant (D) Any Level 2 appeal hearing conducted pursuant to this Section shall be presided over by a Hearing Officer who shall be an attorney licensed to practice law in the State of Nevada. (E) The Hearing Officer may decide in favor of the Level 2 appellant by finding no liability, may find liability but impose a fine in an amount less than that set forth in this Title, or may waive late fees and penalties for any one or more of the reasons set forth in Subsection (C) or Subsection (D) of LVMC 11.10.080. (F) The appellant shall pay the total civil fines and penalties forthwith or at such times and on such conditions as the Hearing Officer shall prescribe if it is found that the person has either failed to appear or otherwise defend against the issuance of the infraction, or that the infraction has been committed and no applicable defense exists. If the appellant fails to pay in accordance with the times and conditions of the Hearing Officer's decision and any amount due remains unpaid thirty days after the date due, all amounts outstanding shall be deemed delinquent, including unpaid portions of the original fine amount and associated penalties. The City shall have the right to collect such amounts by any means set forth in this Chapter or otherwise available under law. (G) Upon reaching a decision, the Hearing Officer shall, as soon as practicable thereafter, file a written decision substantially conforming to the following form: ___________, Appellant vs. City of Las Vegas, Nevada, Parking Services Division, Respondent. Before, ___________, Hearing Officer for the City of Las Vegas, decision is entered in favor of ___________, (appellant or City Parking Services Division) for $_______ (enter $0.00 if judgment is for the appellant), on the ___ day of _______, 20_______. I certify that the foregoing is a correct reflection of the decision entered in the action properly brought for my consideration pursuant to LVMC Chapter 11.10. ___________ Hearing Officer (H) The City Attorney may petition the Las Vegas Municipal Court for the entry of a civil judgment against the appellant in an amount equal to that stated in the written decision of the Hearing Officer if the City Attorney determines this action to be necessary to enforce such decision. Service of such petition on the defendant must be made by certified mail, return receipt requested, restricted delivery, addressed to the registered owner of the vehicle at his last known address, as indicated by the vehicle registration which is maintained by the Nevada Department of Motor Vehicles or in any other manner which is authorized by law. An affidavit or declaration of mailing, a signed, returned receipt, or other evidence of service shall be filed upon such service of the petition. Once a petition for civil judgment pursuant to this Subsection (H) has been filed with the Municipal Court, the assigned judge has jurisdiction to grant or deny the relief prayed for therein. (Ord. Las Vegas Municipal Code § 11.10.110 Filing and processing of a Level 1 appeal or Level 2 appeal.

11.10.110 - Filing and processing of a Level 1 appeal or Level 2 appeal. In connection with the filing and processing of a Level 1 appeal or Level 2 appeal: (A) A person who is an individual may be represented by a member of the person's immediate family, with the written consent of the individual to be represented, or by an attorney who is licensed to practice law in Nevada. A business or other entity may be represented by an officer of the entity or by an attorney who is licensed to practice law in Nevada. (B) A properly filed Notice of Infraction shall constitute a claim of liability and a claim for relief and no other such claim shall be required. Prima facie proof of the violation alleged shall be established by means of a certified copy of the Notice of Infraction or by reference to the data stored in a computer or other device as described in Subsection (C) of LVMC 11.10.030. No formal appearance by the City Attorney's office is required. The hearing and disposition of all appeals shall be informal, with the purpose of dispensing timely and appropriate justice. (C) The burden of proving any defense shall be upon the person raising such defense. (Ord. No. 6437, § 5, 8-5-15)

Las Vegas Municipal Code § 11.10.120 Payment schedules.

11.10.120 - Payment schedules. (A) In connection with a request to arrange a payment schedule pursuant to LVMC 11.10.080(A)(2), or as otherwise made available by the Parking Services Division under this Chapter, the Parking Services Division is authorized to charge an administrative fee in the amount of twenty-five dollars for the establishment of such a schedule. The fee is non-refundable. (B) If a person who has arranged a payment schedule pursuant to this Chapter fails to pay in accordance with the terms and conditions of the schedule and any amount due remains unpaid fifteen days after the date due, all amounts outstanding shall be deemed delinquent, including unpaid portions of the original fine amount and associated penalties. The City shall have the right to collect such amounts by any means set forth in this Chapter or otherwise available under law. (Ord. No. 6437, § 5, 8-5-15)

Las Vegas Municipal Code § 11.10.130 Monetary sanctions for prohibited or unlawful acts.

11.10.130 - Monetary sanctions for prohibited or unlawful acts. (A) Subject to the provisions of Subsection (B), whenever in this Title an act relating to the stopping, standing or parking of a vehicle is prohibited or limited, or the violation of such a prohibition or limitation is made or declared to be unlawful or an offense or a misdemeanor, the sanction therefor is civil in nature in the monetary amount which is set forth in the schedule of fines and penalties. (B) With respect to any particular violation of the following types, the City may proceed either by means of a criminal prosecution or by means of the civil infraction process set forth in this Chapter 11.10: (1) A violation of LVMC 11.54.205 or 11.65.110; (2) A violation of any other provision of Title 11 pertaining to the stopping, standing or parking of a vehicle where the violation relates to the misuse of equipment, or involves fraud, deceit or misrepresentation, or where the language of the provision demonstrates a specific intent for a criminal rather than civil sanction to be applied. Las Vegas Municipal Code § 11.10.140 Schedule of civil fines established.

11.10.140 - Schedule of civil fines established. (A) There is hereby adopted a schedule of fines and penalties for infractions of the parking laws and regulations which are set forth in this Title, as well as infractions processed under this Chapter as civil violations pursuant to LVMC 10.78.020 or 13.04.070(A). The schedule is set forth as Subsection (D) of this Section. In the case of any violation that is not specifically identified in the schedule, the fine shall be twenty-five dollars, with the penalties to be determined as in the case of a violation specifically listed with a fine amount of twenty-five dollars. (B) The owner and/or operator shall be liable for an additional collection fee where the collection of the fines, parking permit fees, parking facility usage fees, and penalties provided for in this Title is referred for collection to a private collection agency. The amount of such fee may not exceed twenty-five percent of the outstanding indebtedness or two hundred fifty dollars, whichever is less. The amount of any such collection fee shall accrue and become due and payable at the time the indebtedness is referred for collection to the collection agency, and that amount may be added by the collection agency or the Parking Services Division to the amount sought to be collected. Any judgment or amended judgment entered under this Chapter may include the amount of the collection fee authorized by this Subsection (B). (C) When a notice of nonpayment of a civil fine imposed under this Chapter has been filed with the Nevada Department of Motor Vehicles pursuant to NRS 484B.527, the City is authorized to charge the party liable an administrative fee of fifteen dollars to cover the costs of the filing, handling and release of the notice of nonpayment. Las Vegas Municipal Code § 11.10.150 Alternative payment of fines—Donation program.

11.10.150 - Alternative payment of fines—Donation program. (A) Notwithstanding the provisions of LVMC 11.10.140 or any other provision of this Chapter, the Parking Services Division, from time to time and upon authorization pursuant to Subsection (B), may operate a program by which fines for parking infractions may be paid by means of the donation of qualifying items in lieu of the payment of money. In order to satisfy the amount of the fine for any particular infraction, the qualifying items donated must be of equal or greater value than the amount of the corresponding fine. (B) A program described in Subsection (A) may be authorized no more than twice per calendar year and must be approved in advance, as to both time period and duration, by the City Manager. The Parking Services Division may establish such procedures and requirements regarding program events as may be desirable or appropriate, including without limitation what types of qualifying items will apply to a particular program event; a range of dates within which parking infractions must have been issued in order to be eligible; and a time period within which donations in lieu of payment must be made. The determination of the value of donations is completely within the discretion of the Parking Services Division. (C) For purposes of Subsections (A) and (B), "qualifying items" means food items, children's toys, or personal items for the benefit of specifically-identified groups in need, including without limitation school supplies. In the case of a failure to pay a required parking fee as referenced in LVMC 11.52.310 and 11.52.320, the City is entitled to collect the required parking fee in addition to and independent of any civil fine that may be imposed, and the fee amount shall be added to and be collectible with the amount of fines and penalties associated with the violation. It is unlawful to physically obstruct, or commit assault or battery upon, a parking enforcement officer of the City, or an employee or agent of a person or entity providing parking-related services to the City by contract. 11.10.200 - Removal of vehicle—Circumstances. (A) The Las Vegas Metropolitan Police Department, the Department of Public Safety, and the Parking Services Division of the Department of Economic and Urban Development are authorized to remove a vehicle to the nearest garage or other place that has been designated for vehicle storage by the City, under the circumstances which are hereinafter enumerated: (1) When any vehicle is left unattended upon any highway, bridge, viaduct or causeway, or in any tube or tunnel, if such vehicle constitutes an obstruction to traffic; (2) When a vehicle upon a street or highway is so disabled as to constitute an obstruction to traffic and the person who is in charge of such vehicle is, by reason of physical injury or other reason, incapacitated to the extent that he is unable to provide for its custody or removal, or is not in the immediate vicinity of the disabled vehicle; (3) When any vehicle is illegally parked in a parking space or location for twenty-four hours or more or is parked so illegally as to constitute a definite hazard or obstruction to the normal movement of traffic; (4) When the person who is in charge of a vehicle is unable to provide for its custody or removal within: (a) Twenty-four hours after abandoning such vehicle on any freeway, United States highway or other primary arterial street, or (b) Seventy-two hours after abandoning such vehicle on any other street; (5) When the person who is driving or in actual physical control of a vehicle is arrested for any alleged offense for which the arresting officer is required by law to take such person before a proper magistrate without unnecessary delay; or (6) In accordance with Section 11.10.240. (B) As used in this Section 11.10.200 to Section 11.10.280, the term "vehicle" shall include any automobile, motorcycle, truck, boat trailer, utility trailer, or any other vehicle capable of being driven or towed on any street, highway, or right-of-way. (C) Prior to the release of any vehicle impounded pursuant to this Section, the operator, registered owner or his designee must pay the costs of such impoundment. (Ord. No. 6518, § 17, 4-6-16; Ord. Whenever a person removes a vehicle, as authorized in LVMC 11.10.200, and such person knows or is able to ascertain from the registration records in the vehicle or by other reasonable means the name and address of the owner thereof, such person must immediately give, or cause to be given, notice in writing and by telephone, if possible, to the owner of the fact of such removal, the reasons therefor and the place to which the vehicle has been removed. In the event that the vehicle is stored in a public garage, a copy of the notice shall be given to the proprietor of the garage. (Ord. 3829 § 1 (part), 1994)

Whenever a person removes a vehicle pursuant to LVMC 11.10.200 and does not know and is not able to ascertain the name of the owner, or for any other reason is unable to give the notice to the owner, as provided in LVMC 11.10.210, and the vehicle is not picked up by the owner or his designee within a period of three days, such person must immediately send or cause to be sent a written notice of such removal by mail to the Nevada Department of Motor Vehicles and file a copy of such notice with the proprietor of the garage or place in which the vehicle is stored. Such notice must include a complete description of the vehicle, the date, time and place from which it was removed, the reasons for such removal and the name of the garage or place in which the vehicle is stored. Las Vegas Municipal Code § 11.10.230 Writs of execution—Authorized.

11.10.230 - Writs of execution—Authorized. (A) The use of writs of execution issued by the Las Vegas Municipal Court is authorized within the City as an aid in the enforcement of the parking ordinances of the City. (B) The City of Las Vegas in whose favor a judgment is given may upon the entry of such judgment, or at any time before the judgment expires, obtain the issuance of a writ of execution for its enforcement as prescribed in Chapter 21 of the Nevada Revised Statutes and Justice Court Rules of Civil Procedure, Rule 69. Such issuance may be conditioned upon the failure of the judgment debtor to pay the judgment and expenses of enforcement thereof within a specified period of time or any other reasonable and just condition. (C) Upon the City's request, a writ of execution issued pursuant to Subsection B of this Section shall allow the City to obtain possession of the defendant's vehicle(s) through towing the vehicle(s), at the expense of the defendant, from any public street, highway, viaduct, causeway, parking space, tube, tunnel, bridge or alley in compliance with the procedures prescribed in Sections 11.10.210 and 11.10.220. Upon the City's request, a writ of execution issued pursuant to Subsection B of this Section shall allow the City to obtain possession of the defendant's vehicle(s) through the use of an immobilizing device. A fee of fifty dollars per vehicle shall be recovered from the owner or operator of the vehicle(s) prior to the removal of the immobilizing device. (D) Notwithstanding the provisions of Subsection (C), the City may, without obtaining a writ of execution, obtain possession of a vehicle by means of an immobilizing device in accordance with Section 11.10.240. Las Vegas Municipal Code § 11.10.240 Automobile immobilizer—Conditions for use.

11.10.240 - Automobile immobilizer—Conditions for use. (A) The City is authorized to attach an immobilizing device to a vehicle that is parked on any public right-of-way or City-owned or operated lot if the vehicle is included on an immobilization eligibility list. A vehicle may be included on an immobilization eligibility list only if: (1) The registered owner of the vehicle has accumulated more than two hundred dollars in unpaid civil fines, judgments and penalties, and at least two Notices of Infraction have been issued and served with respect to that vehicle and have not been responded to within the time set forth in Section 11.10.090; and (2) At least twenty-one days before including the vehicle on the list, the City provided notice of impending vehicle immobilization in accordance with Subsection (B) of this Section. (B) Notice of impending vehicle immobilization shall be provided by mailing such notice to the registered owner of the vehicle at the address last known to the City or on file with the Nevada Department of Motor Vehicles. The notice shall include the dates and nature of the infractions which formed the basis for the civil fines, judgments and penalties; the numbers of the Notices of Infraction; and the amounts owing. The notice shall advise that the registered owner may challenge the validity of the notice by requesting a hearing. The hearing shall be held before the Hearing Officer for the sole purpose of allowing the registered owner to show that: (1) The amounts in question have been paid; or (2) The vehicle was not properly included on the immobilization eligibility list in accordance with the provisions of Subsection (A) of this Section. (C) A vehicle shall be removed from the immobilization eligibility list if: (1) The registered owner pays all fines, judgments, penalties and applicable immobilization fees; (2) The registered owner executes an agreement to pay within a specified period of time all fines, judgments, penalties and applicable immobilization fees, with a condition that, for default on the payment obligation, the vehicle shall be subject to reinstatement on the immobilization list; or (3) The Hearing Officer finds that the vehicle was not properly included on the immobilization eligibility list. (D) In connection with the immobilization of a vehicle, a notice shall be attached to the vehicle in a conspicuous place advising: (1) That the vehicle is immobilized and that any attempt to move the vehicle may result in its damage; (2) That the unauthorized removal of or damage to the immobilizing device is a violation of law; (3) How release of the immobilizing device may be obtained; and (4) How a hearing may be obtained pursuant to Subsection (H). (E) The City may (but is not obligated to) cause to be towed and stored any vehicle which has been immobilized if, within twenty-four hours after immobilization, no arrangements have been made for the vehicle's release. An unregistered vehicle that is immobilized may be towed and stored immediately. Within ten days after an immobilized vehicle is towed, the City shall send a notice advising that the vehicle has been immobilized and towed. The notice shall be provided by means of certified mail, return receipt requested, mailed to the registered owner at the address last known to the City or on file with the Department of Motor Vehicles. The notice shall state that the registered owner is entitled to request a hearing pursuant to Subsection (H) of this Section to determine the validity of the immobilization. If a vehicle is towed pursuant to this Subsection (E), the City (or a tow operator acting at the City's direction) is authorized to remove the immobilization device for purposes of transportation and reapply the device after the vehicle is stored at the location designated for storage by the City. (F) An immobilization fee of seventy-five dollars shall be paid by or on behalf of the registered owner of the vehicle prior to the removal of an immobilizing device. (G) Release of an immobilized vehicle, either by the City or by an authorized tow operator who has been directed by the City to do so, may be obtained by: (1) The payment of all fines, judgments, penalties and applicable immobilization, towing and storage fees; or (2) In connection with the request of a hearing to determine the validity of the immobilization of the vehicle, the posting of a bond or other sufficient undertaking in an amount which will satisfy all fines, judgments, penalties and applicable immobilization, towing and storage fees. (H) The registered owner of a vehicle may request a hearing regarding the immobilization of the owner's vehicle. The request for hearing must be made within ten days after the date of the notice described in Subsection (D) or Subsection (E) of this Section. The hearing shall be held before the Hearing Officer and shall be limited to a determination of whether there was a factual and legal basis for the immobilization. Failure to request or attend a hearing shall be deemed a waiver of the right to a hearing. If the Hearing Officer determines that there was a factual and legal basis for the immobilization, the bond or undertaking shall be forfeited. If the hearing officer determines that there was an insufficient factual and legal basis for the immobilization, the bond or undertaking shall be exonerated. (Ord. No. 6437, § 9, 8-5-15; Ord. Las Vegas Municipal Code § 11.10.245 Unlocking/releasing of immobilization device.

11.10.245 - Unlocking/releasing of immobilization device. In connection with the use of an immobilization device pursuant to this Chapter, the City is authorized to employ, either by itself or by means of contract, equipment and technologies that allow the operator or owner of a vehicle to unlock or otherwise release the immobilization device by the electronic payment of delinquent fines and immobilization fees. In connection with the use of such equipment and technologies, and in addition to and independent of applicable immobilizer fees under this Title, the City may require the operator or owner of a vehicle to: (A) Acknowledge responsibility to return an immobilization device to a designated location within a specified time period; and (B) Authorize a hold to be placed on a debit or credit card account in the amount of seventy-five dollars, to be either: 1) released when the device is properly returned, or 2) kept by the City or its vendor if the device is not properly returned within the specified time period. Las Vegas Municipal Code § 11.10.250 Writ of execution—Procedure upon issuance.

11.10.250 - Writ of execution—Procedure upon issuance. Upon the issuance of a writ of execution pursuant to Section 11.10.230, the provisions of Chapter 21 of the Nevada Revised Statutes shall apply, including the following: (1) The writ must be issued in the name of the City of Las Vegas, sealed with the seal of the Las Vegas Municipal Court, subscribed by a clerk of such court, directed to the Sheriff of Clark County or the sheriff of the county where the real or personal property subject to execution is located and otherwise in substantially the same form as directed by Nevada Revised Statutes 21.025. (2) A notice of execution as prescribed in Nevada Revised Statute 21.075 and 21.076 must be prepared with the City of Las Vegas named as the judgment creditor. (3) The notice and a copy of the writ must be provided to the Sheriff who must serve the notice on the defendant—judgment debtor by regular mail at his last known address, or, if represented by an attorney, at the attorney's office. The notice must be served by regular mail the next business day after the writ of execution was served. (4) In order to claim exemption of any property, the defendant must, within eight calendar days after the notice is mailed, serve the Sheriff and the City of Las Vegas, through the City Attorney and file with a Clerk of the Las Vegas Municipal Court an affidavit setting out the claim of exemption. The Municipal Court Administrator shall provide the form for the affidavit. (5) When the affidavit is served, the Sheriff shall release the property unless within five calendar days after written demand by the Sheriff, the City of Las Vegas files a motion for a hearing to determine whether the money or property is exempt. (6) The hearing to determine whether the property or money is exempt must be held within ten calendar days after the filing of the motion for a hearing, unless the court continues the hearing for good cause shown. The defendant shall receive at least five calendar days' notice of the hearing. (7) If at any time the defendant satisfies the judgment, including costs for the enforcement thereof, any property taken pursuant to a writ of execution shall be released to the defendant as soon as possible thereafter. 11.10.260 - Failure to timely file claim of exemption. If the defendant—judgment debtor fails to timely file a claim of exemption or fails to appear at the scheduled hearing to resolve the validity of the claimed exemption, title and/or lawful possession of the property taken pursuant to the writ of execution may be transferred in satisfaction of the judgment and expenses of enforcing such judgment as provided by Chapter 21 of the Nevada Revised Statutes. If such property is sold, any amount received in excess of the judgment and expenses shall be returned to the judgment debtor as provided by Chapter 21 of the Nevada Revised Statutes. 11.10.280 - Automobile immobilizers—Unlawful acts—Exceptions. (A) Except as otherwise provided in Subsection (B), it is unlawful for any person to deface, damage, tamper with, open, break, destroy or remove any immobilizing device; impair the usefulness thereof; leave such a device attached to the immobilized vehicle and transport it to another location for purposes of depriving the City of its use; or attempt to do any of those acts. (B) The prohibitions described in Subsection (A) do not apply to the acts of any of the following when acting within the scope of their duties or employment: (1) A City officer, employee, or contractor engaged in the parking enforcement function; (2) A peace officer; or (3) A person engaged in the provision of emergency services. Las Vegas Municipal Code § 11.10.290 Parking enforcement services.

11.10.290 - Parking enforcement services. (A) The Parking Services Division is authorized to enter into agreements with the owners or lessees of parking lots or parking structures by which the Division will provide parking enforcement services related thereto. The Division shall enforce the parking prohibitions, rules, regulations and limitations that have been agreed upon and established by means of any such agreements. The prohibitions, rules, regulations and limitations to be enforced pursuant to any such agreement may include: (1) The parking-related provisions of this Title as if the parking lot or structure were a City parking facility under this Title; (2) The parking prohibitions, rules and regulations that the property owner or lessee has established for the lot or structure; or (3) Any combination thereof. (B) Unless otherwise specified in an agreement referred to in Subsection (A), the parking prohibitions, rules, regulations and limitations established by the agreement shall be deemed to be the City's parking prohibitions, rules, regulations and limitations for purposes of the enforcement provisions, fines and other remedies of this Title. In the case of a parking prohibition, rule, regulation or limitation established by an agreement referred to in Subsection (A) that does not correspond directly to a prohibition, rule, regulation or limitation described in this Title, the Division, for enforcement purposes, is authorized to treat the agreed-upon prohibition, rule, regulation or limitation as if it were the prohibition, rule, regulation or limitation of this Title that most closely corresponds. (C) In order to enforce any parking prohibition, rule, regulation or limitation referred to in Subsection (A), notice of the applicable prohibition, rule, regulation or limitation must be provided to those who will be parking vehicles in the lot or structure, whether by means of signage or otherwise.
