Oklahoma City Municipal Code § 54-16 Definitions.

§ 54-16. - Definitions. The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning: (1) Automobile and merchandise salvage dealers means persons who purchase, trade for or otherwise acquire any previously used merchandise or any previously used automobile or any parts thereof for the purpose of breaking down or otherwise separating and salvaging parts therefrom, for the purpose of resale or offering for resale or for trade or exchange or other disposition of the salvage part. (2) Secondhand or used automobile parts or accessory dealers means persons dealing in secondhand or used automobile parts or accessories either by purchasing, selling, offering for sale, trading, exchanging or otherwise acquiring or disposing of the parts or accessories, including persons who rebuild or deal in any other secondhand or used automobile parts or accessories in any manner set forth under this section. Oklahoma City Municipal Code § 54-17 Compliance.

§ 54-17. - Compliance. No dealer in secondhand or used automobiles or trailers, automobile or merchandise salvage dealer, or dealer in secondhand or used automobile parts and accessories shall violate any provision of this article. (Code 1970, § 9-39(a); Code 1980, § 54-17)

Oklahoma City Municipal Code § 54-18 Sales on Sunday.

§ 54-18. - Sales on Sunday. (a) No person shall keep open any store, sales room or sales place for the purpose of carrying on the business of selling, purchasing, trading for or otherwise acquiring or disposing of new and secondhand automobiles or engaging in such business in any other manner on Sundays. (b) No person shall operate or keep open any store, salvage yard, warehouse, sales room, or sales place on Sundays, for the purpose of carrying on or engaging in the business of automobile or merchandise salvage dealers or dealers in secondhand or used automobile parts and accessories. (c) This section shall not apply to a person who uniformly keeps another day of the week as holy time and does not labor upon that day. (Code 1970, §§ 9-42, 9-43; Code 1980, § 54-18)

Oklahoma City Municipal Code § 54-19 Transactions with minors.

§ 54-19. - Transactions with minors. No person in charge of any merchandise salvage or used automobile parts and accessories shop or place of business shall purchase or otherwise receive from or sell or otherwise deliver to any minor any article of value or have any other dealings in respect to the title of property in the possession of a minor without the written consent of the parent or guardian of such minor. Oklahoma City Municipal Code § 54-20 Used car dealers and garages; records and reports.

§ 54-20. - Used car dealers and garages; records and reports. (a) Every person engaged in the business of buying, selling, exchanging, or dealing in used or secondhand motor vehicles shall keep a record of the purchase, sale, exchange or storage of such vehicles. Such record shall at all times be open to the inspection of any officer of the Police Department. (b) Within 24 hours after the purchase, sale, exchange or acceptance for storage of such vehicle, every person designated above shall make out and deliver to the Chief of Police, or persons in the Police Department designated by the Chief of Police to receive same, a full and complete record of the purchase, sale, exchange or acceptance for storage of such used or secondhand vehicles. Such record and report shall contain the name and address of the person from whom the vehicle was purchased or taken in exchange, or for storage, or to whom sold, the make, style, and color, State license number, motor number, and serial number. The report shall be written in the English language in a clear and legible manner on blanks furnished by the Police Department. (Code 1970, § 9-34; Code 1980, § 54-20)

Oklahoma City Municipal Code § 54-21 Salvage dealers and automobile parts and accessories dealers; records and reports.

§ 54-21. - Salvage dealers and automobile parts and accessories dealers; records and reports. (a) Every person licensed to engage in the business of automobile or merchandise salvage or secondhand automobile parts and accessories shall keep a record of the purchase, sale, exchange or other handling of any and all articles coming into the possession of the licensee. Such record shall at all times be subject to the inspection of any officer of the Police Department. (b) Such records shall contain the name and address of the person from whom the articles are purchased, taken in, exchanged or otherwise received, the automobile license number of the vehicle being driven by such person, if any, and any other information that will thereafter assist the police in establishing the identity of such persons. A record shall be kept of the description of the articles purchased, taken in, exchanged or otherwise delivered, including any number that may be in or upon any such article. The record shall be written in the English language in a clear and legible manner. (c) Every such automobile or merchandise salvage dealer or secondhand automobile parts and accessories dealer shall make out and deliver or mail to the Chief of Police each day before the hour of 12:00 noon, a legible and correct copy from such records of all articles purchased, taken in, exchanged or otherwise received, sold, or otherwise delivered during the preceding day. The record shall include the time when such articles were purchased or otherwise received and sold or otherwise delivered and a description of the person from whom such articles were purchased and to whom such articles were delivered. Such reports shall be made on forms prescribed and furnished by the Chief of Police. (d) No person shall be required to furnish such description of any property purchased from manufacturers or wholesale dealers having an established place of business or of any goods purchased at open sale or from any bankrupt stock, but such goods must be accompanied by a bill of sale or other evidence of open and legitimate purchase and must be shown to any officer when demanded. Oklahoma City Municipal Code § 54-22 Exemption.

§ 54-22. - Exemption. The provisions of this article shall not apply to the operation of filling stations, garages, and other business establishments that handle and sell only new automobile parts and accessories. (Code 1970, § 9-44; Code 1980, § 54-24)
