San Antonio Unified Development Code § 35-C101 Generally.

Sec. 35-C101. - Generally. (a) Purpose. The purpose of this appendix is to establish the fee amounts for administrative fees, which are designed to defray the costs incurred by the city for administering this chapter and/or for providing off-site infrastructure attributable to new development. (b) Amendment. The fees established herein may be revised from time to time provided, however, that the fees shall not exceed the reasonably anticipated costs associated with the issuance, investigation and monitoring of permits required by this chapter. (c) Effect. No application for development approval shall be accepted until the applicant has paid all processing fees as set forth herein. Fees paid shall be non-refundable except as provided in subsection (f), below. (d) Earmarking. There shall be established with the city treasurer an escrow fund for purposes of reimbursing the departments responsible for processing the permit applications subject to this appendix for services rendered in connection with administration of this chapter or any other chapter or section of the City Code related to land development or building construction. The funds contained in said escrow account shall be used solely to reimburse the departments for actual costs associated with administration of the this chapter or any other chapter or section of the City Code related to land development or building construction. (e) Credit. The applicant may apply to the board of adjustment for a credit against a fee previously paid in the event that a portion of the costs of review and processing is duplicative, pursuant to the standards of applicable case law or statutes then in effect. (f) Refund. After the approval, conditional approval or denial of an application for approval as set forth herein, the city shall refund to the applicant any unexpended or unencumbered balance of the escrow account established herein for said application. (g) Technological Improvement Fee. An amount of three (3) percent of the fee assessed for zoning and platting permits required by this Code shall be required to be paid, in addition to the permit fee, at the time of application for any of the aforementioned permits. San Antonio Unified Development Code § 35-C102 Zoning Fees.

Sec. 35-C102. - Zoning Fees. (a) Generally. When an application is filed for a change of zoning district boundaries or for any change of the zoning ordinance or classification, such application shall be accompanied by one-half (½) of the filing fee specified in subsection (b) prior to consideration of the application by the zoning commission. A second fee in the same amount (i.e., one-half (½) of the filing fee specified in subsection (b), below) shall be required prior to consideration of an application by the city council. In addition to the filing fees specified above or to the fees required by section 35-703 for nonconforming rights, an additional fee as specified in herein shall be required by the San Antonio Water System when an application is filed which requires preparation of a report by the watershed quality planner of the San Antonio Water System. San Antonio Unified Development Code § 35-C104 Zoning Verification Fees.

The department of planning and development services will provide written verification of the zoning district of a property and/or compliance of site improvements with the zoning requirements upon payment of the appropriate fee(s) explained in Exhibit C. San Antonio Unified Development Code § 35-C107 Sexually Oriented Businesses.

Sec. 35-C107. - Sexually Oriented Businesses. A "sexually oriented business certificate of occupancy fee" of six hundred fifty ($650.00) dollars shall be paid to the City of San Antonio with the submission of each application for a certificate of occupancy for a sexually oriented business to pay for the cost of review and verification of accuracy of the application, survey maps, ownership information, and conformance with other certificate requirements. San Antonio Unified Development Code § 35-C108a Local Government Code, Chapter 245, Rights Determination.

Sec. 35-C108a. - Local Government Code, Chapter 245, Rights Determination. For a homestead (one (1) lot or less than three (3) acres) a fee of two hundred dollars ($200.00) and for residential over one (1) lot or three (3) acres or more a fee of one thousand dollars ($1,000.00) shall be paid for the processing of any vested rights determination pursuant to section 35-711 of this chapter. San Antonio Unified Development Code § 35-C108b Vested Rights Appeal.

Sec. 35-C108b. - Vested Rights Appeal. A fee of five hundred dollars ($500.00) shall accompany filing of an application for an appeal of a vested rights determination to the planning commission. Subsequent to the planning commission taking action on a vested rights application the applicant may appeal the determination of the planning commission to the city council by filing an application for an appeal of the planning commission's determination of vested rights accompanied by a fee of five hundred dollars ($500.00) with the office of the city clerk. San Antonio Unified Development Code § 35-C109 Regional Stormwater Management Program (RSWMP) Fees.

Sec. 35-C109. - Regional Stormwater Management Program (RSWMP) Fees. The following fees are established as fee-in-lieu of providing detention for participation in the regional stormwater management program of the City of San Antonio. When approved by the director of public works (requirements are defined in section 35-504) the fees must be paid before a subdivision plat is recorded for single-family and two-family (duplex) developments or a building or site work permit is released. For all other types of development associated with application for plat identification number/letters of certification or building permit application, as applicable, submitted on or after the effective date specified in table I, the fee will be based on 1) the proposed impervious cover identified in the accepted stormwater management plan for single-family and two-family (duplex) developments, 2) impervious cover identified in the building or site work permit for all other types of development, or 3) impervious area of the proposed construction of roadways and sidewalks not identified on the major thoroughfare plan. Development types for public rights-of-way (with the exception of roadways on the major thoroughfare plan) shall be equivalent to the adjacent development type(s). Where development types are different from one side of the right-of-way to the other, each development type shall be assumed to extend to the centerline of the right-of-way fronting, adjacent, and/or abutting the development. Roadways on the major thoroughfare plan shall be exempt from payment of RSWMP fees. For redevelopment projects, the RSWMP fees will only be assessed for the increase in impervious cover based on the land use categories and fees in table I. No refunds will be provided for any reductions in impervious cover or if the calculated difference is less than previous fees paid. In a case where the fees were not previously assessed, but will be assessed at the permit stage, the fees in effect at the time the permit application is submitted will apply to the building or site work permit. For mixed use developments, the predominant land use shall be used to determine the fee rate category. Low impact development (LID) features and open drainage channels lined with impervious material are considered as pervious areas for the purpose of determining the RSWMP fees. RSWMP fees shall be paid at either the platting stage or at the building permit stage. Proof of payment of RSWMP fees will be required for development projects outside the city limits and in the city's extra territorial jurisdiction (ETJ). No building and site work permit authorizations will be issued in the ETJ without proof of payment of RSWMP fees to the City of San Antonio. (Ord. No. 2009-01-15-0001, § 2, 1-15-09) (Ord. San Antonio Unified Development Code § 35-C111 Master Plan Amendments.

Sec. 35-C111. - Master Plan Amendments. A fee of five hundred dollars ($500.00) shall be paid for any amendment of the major thoroughfare plan and a fee of four hundred fifty dollars ($450.00) shall be paid for the processing of any master plan amendments pursuant to section 35-421 of this chapter. San Antonio Unified Development Code § 35-C113 Vending Permit Fees.

Sec. 35-C113. - Vending Permit Fees. (a) A vending permit fee of seven hundred fifty dollars ($750.00) shall be paid to the City of San Antonio with the submission of each application for a vending permit for one (1) location to pay for the cost of review and verification of accuracy of the application and conformance with the other requirements of this chapter. An additional vending permit fee of one hundred dollars ($100.00) shall be paid for each additional location. (b) A group vending permit fee of seven hundred fifty dollars ($750.00) shall be paid to the City of San Antonio with the submission of each application for a group vending permit for one (1) location to pay for the cost of review and verification of accuracy of the application and conformance with the other requirements of this chapter. An additional group vending permit fee of one hundred dollars ($100.00) shall be paid for each additional location. (c) A public property vending permit fee of seven hundred fifty dollars ($750.00) shall be paid to the City of San Antonio with the submission of each application for a vending permit for one (1) location to pay for the cost of review and verification of accuracy of the application and conformance with the other requirements of this chapter.
