San José Municipal Code § 20.200.325
in effect"Accessory Dwelling Unit" or "Accessory Dwelling" means an attached or detached residential dwelling which is ancillary to a One-Family, Two-Family, or Multiple-Family Dwelling and provides complete independent living facilities for one or more persons that include permanent provision for living, sleeping, eating, cooking, and sanitation on the same parcel as the One-Family, Two-Family, or Multiple-Family Dwelling is situated.
