Las Vegas Municipal Code § 13.24.010 Definitions.

13.24.010 - Definitions. For the purpose of this Chapter, certain words and phrases shall be construed herein as set forth in this Section, unless it is apparent from the context that a different meaning is intended: "Block" or "block face" means one side of a street between two consecutive intersecting streets. "Director" means the Director of Public Works or his designee. "News rack" means any self-service or coin-operated box, containers, storage unit or other dispenser installed, used, or maintained for the displaying or dispensing of newspapers, news periodicals, magazines or other publications. "Parkway" means that area between the sidewalks and the curb of any street, and where there is no sidewalk, that area between the edge of the roadway and the property line adjacent thereto. "Parkway" also includes any area within a roadway which is not open to vehicular travel. "Roadway" means that portion of a street improved, designed, or ordinarily used for vehicular travel. "Sidewalk" means any surface provided for the exclusive use of pedestrians. "Street" means all that area dedicated to public use for public street purposes and shall include, but not be limited to, roadways, parkways, alleys and sidewalks. Las Vegas Municipal Code § 13.24.015 Applicability.

13.24.015 - Applicability. The provisions of this Chapter do not apply to news racks within the boundaries of the Fremont Street Experience pedestrian mall, as described in LVMC 11.68.040. The location and design of news racks within the pedestrian mall, and the allocation of news rack locations, are governed by the Fremont Street Experience Limited Liability Company in accordance with its news rack plan. Las Vegas Municipal Code § 13.24.020 Identification on news rack.

13.24.020 - Identification on news rack. (A) Every person or other entity which places or maintains a news rack on a public sidewalk or parkway of the City shall: (1) Obtain from the City a permit sticker for that news rack in accordance with Subsection (B) of this Section; (2) Affix to the news rack, in a prominent location so as to be readily visible from the adjacent roadway, the permit sticker referred to in Paragraph (1) above; (3) Affix to the news rack, in a prominent location so as to be readily visible but limited to an area no greater than six square inches, the name, address and telephone number of the persons or entities responsible for the placement and maintenance of the news rack; and (4) Maintain in place and in readable condition the permit sticker and other information affixed to the news rack in accordance with this Subsection (A). (B) Permit stickers for authorized news racks will be issued by the City on an annual basis, or as needed. In accordance with Section 13.24.025, the Director is authorized to charge a fee for each initial, renewal or replacement permit sticker, and the fee must be paid in order to obtain such a sticker. A permit sticker must be affixed to the news rack to which it pertains within thirty days after its issuance. (Ord. Las Vegas Municipal Code § 13.24.025 News rack fees.

13.24.025 - News rack fees. (A) The Director is authorized to charge the following fees under this Chapter: (1) A nonrefundable permit sticker fee of fifty dollars for each initial, renewal or replacement permit sticker issued under Section 13.24.020. (2) A nonrefundable application fee of two dollars for each application submitted under Section 13.24.085 or 13.24.210, or two dollars for each location applied for if the Director accepts multi-location applications. (B) The fees authorized by this Section are intended, and may only be used, to partially offset the costs of processing applications, issuing permit stickers, and administering and enforcing this Chapter. (C) Upon the request of an owner or operator with more than one hundred news racks, the Director may authorize the owner or operator to pay the sticker fees described in Subsection (A) in installments rather than requiring full payment before issuance. The authorization shall be in the form of a written agreement approved by the Director, which may contain provisions that provide a remedy in the event timely payments are not made. Such provisions may include without limitation provisions authorizing the suspension or revocation of permit stickers and the removal of news racks. (Ord. No. 6138, § 2, 4-6-11)

Las Vegas Municipal Code § 13.24.030 Insurance.

13.24.030 - Insurance. Every person or other entity which places or maintains a news rack on a public sidewalk or parkway in the City shall provide and keep in force during the time that such news rack is allowed to remain on public property, a policy of public liability insurance, naming the City as an additional insured, in an amount not less than two hundred thousand dollars combined single limit for any injury to persons and/or damage to property for reason of the installation, use and maintenance of such news racks on public property. Said policy shall provide that the insurance coverage shall not be cancelled or reduced by the insurance carrier without the City having been given thirty days prior written notice thereof by such carrier. Las Vegas Municipal Code § 13.24.040 Projection or placement on roadway.

13.24.040 - Projection or placement on roadway. No person shall install, use or maintain any news rack which projects onto, into or over any part of the roadway of any public street, or which rests, wholly or in part, upon, along or over any portion of the roadway of any public street. Las Vegas Municipal Code § 13.24.050 Dangerous or obstructing placement.

13.24.050 - Dangerous or obstructing placement. No person shall install, use or maintain any news rack which in whole or in part rests upon, in or over any public sidewalk or parkway when: (A) Such installation, use or maintenance endangers the safety of persons or property, or when such site or location is used for public utility purposes, public transportation purposes, or other governmental use, or when such news rack unreasonably interferes with or impedes the flow of pedestrian or vehicular traffic, including the ingress into or egress from any residence, place of business, or any legally parked or stopped vehicle or interferes with the use, service or maintenance of poles, posts, traffic signs or signals, hydrants, mailboxes, trash receptacles, or other objects permitted at or near said location; (B) The news rack has not been authorized by the issuance of an identification number; or (C) The news rack has been installed at a location other than that authorized for the installation of that news rack, or is not in compliance with the assigned location information on file with the Department. Las Vegas Municipal Code § 13.24.060 Standards for sidewalk or parkway placement.

13.24.060 - Standards for sidewalk or parkway placement. Any news rack which in whole or in part rests upon, in or over any public sidewalk or parkway, shall comply with the standards set out through Section 13.24.130. (Ord. 1843 § 1 (part), 1976: prior code § 9-12A-4 (part))

Las Vegas Municipal Code § 13.24.070 Dimensions.

13.24.070 - Dimensions. No news rack shall exceed five feet in height, thirty-two inches in width, or eighteen inches in depth. No news rack shall weigh more than one hundred twenty pounds, exclusive of contents. (Ord. 5110 § 6, 1998: Ord. 1843 § 1 (part), 1976: prior code § 9-12A-4(A))

Las Vegas Municipal Code § 13.24.080 Orientation to curb, building, opposite racks.

13.24.080 - Orientation to curb, building, opposite racks. News racks shall only be placed near a curb or adjacent to the wall of a building. News racks placed near the curb shall be placed parallel to the curb and no less than eighteen inches nor more than twenty-four inches from the face of the curb. News racks placed adjacent to the wall of a building shall be placed parallel to such wall and not more than six inches from the wall. No news rack shall be placed or maintained opposite another news rack on the same sidewalk in the same block unless it is more than fifty feet from the nearest opposite news rack. Las Vegas Municipal Code § 13.24.083 Placement of news racks outside of Zone A—Application.

13.24.083 - Placement of news racks outside of Zone A—Application. (A) Within ninety days after the effective date of the ordinance codified in this chapter, each publication, person or other entity desiring to maintain one or more existing news racks, or to place one or more new news racks, outside of Zone A shall file an application with the Director, indicating those locations at which it desires to have news racks. The application shall be made on a form established by the Director. (B) In order to be considered complete, an application must include or be accompanied by: (1) Evidence that the insurance requirements of this Chapter will be met regarding each news rack to be assigned to the applicant; (2) Evidence that the owner of the news racks, and any publications to be displayed in those news racks, have obtained business licenses to operate in the City, or are exempt from licensing requirements; and (3) A listing of all publications to be displayed in each news rack. (C) Based upon the applications received and the standards and procedures set forth in this Section, the Director shall assign specific news rack locations as follows: (1) News racks which are existing as of October 14, 1998, and which are in compliance with all requirements of this Chapter (other than the approval of locations and issuance of identification numbers, and the block-face limitation contained in Subsection (A) of Section 13.24.090), or which were brought into compliance therewith within thirty days after the effective date of said ordinance, shall be allowed to remain until abandoned or removed by the owner or otherwise removed in accordance with this Chapter. News racks for which applications for locations were on file on October 14, 1998, may be assigned locations irrespective of the block-face limitation contained in Subsection (A) of Section 13.24.090, provided they comply with all other requirements of this Chapter. (2) For each block face for which applications have been filed and for which additional locations are still available after the ninety-day period referred to in Section 13.24.083, the Director shall assign any remaining locations. For any block face concerning which the number of applications for that block face do not exceed the available locations, the assignment of locations shall be according to the order in which the applications were filed and deemed to be complete in accordance with Subsection (B) of this Section. (3) For any block face concerning which more locations are applied for than are available, the Director shall assign remaining locations by placing into a container the names of all publications competing for the location. Names shall be drawn from the container, one at a time, until the remaining number of unassigned locations on the block face have been assigned. The drawing shall be open to the public. Las Vegas Municipal Code § 13.24.085 Procedure for permitting locations for news racks outside of Zone A.

13.24.085 - Procedure for permitting locations for news racks outside of Zone A. The procedure for permitting locations for news racks outside of Zone A shall be repeated annually on the second Thursday of February for those locations where there is competition between publications seeking to locate on a particular block face. The Director shall establish such submittal and deadline requirements as may be necessary in order to accomplish the purposes of this Section each year. (Ord. 5110 § 8, 1998)

Las Vegas Municipal Code § 13.24.090 Adjacent placement.

13.24.090 - Adjacent placement. (A) Except as otherwise provided in this Chapter, no more than six news racks may occupy a single block face. (B) No single publication may be made available in more than one news rack within the same block face. Ord. 5110 § 9, 1998: (Ord. 1843 § 1 (part), 1976: prior code § 9-12A-4(C))

Las Vegas Municipal Code § 13.24.095 Placement—Authorization—Forfeiture.

13.24.095 - Placement—Authorization—Forfeiture. (A) The placement of news racks within the City shall be under the direction of the Director of Public Works. In the case of a news rack which has been approved pursuant to this Chapter, if the owner or other person who is authorized to place the news rack fails to occupy that location for a period of fifteen days after notice, the Director of Public Works may declare a forfeiture of the approval and allow other persons to occupy the location with news racks. Notification shall be deemed complete upon depositing same with the U.S. Mail Service using the address supplied to the Department of Public Works by the person securing the location. (B) Except as otherwise permitted in this Chapter, no person may place, remove or stock a news rack unless that person is the owner of the news rack; the owner of a publication authorized to be placed therein; a principal, employee of such owner; or a properly-licensed independent contractor or other authorized agent of such owner. Las Vegas Municipal Code § 13.24.100 Method of joining.

13.24.100 - Method of joining. News racks may not be chained together but may be bolted or clamped to one another, provided that: (A) No more than four news racks are joined together in this manner; (B) A space of no less than four feet separates each group of news racks; and (C) The owners of the affected news racks consent in writing to the joining and to the manner thereof. Las Vegas Municipal Code § 13.24.110 Prohibited locations.

13.24.110 - Prohibited locations. Notwithstanding any other provision of this Chapter, no news racks shall be placed, installed, used or maintained: (A) Within five feet of any marked crosswalk; (B) Within seventeen feet of the curb return of any unmarked crosswalk; (C) Within five feet of any fire hydrant, fire call box, police call box or other emergency facility; (D) Within five feet of any driveway or alley; (E) Within twenty-five feet ahead of, and five feet to the rear of, any sign marking a designated bus stop; (F) Within six feet of any bus bench; (G) In such a manner as to impede or interfere with the reasonable use of a window used for display purposes; (H) In such a manner as to be affixed to any sidewalk, street or other City property, except as provided in LVMC 13.24.115; (I) Within six feet of the boundary of the Fremont Street Experience pedestrian mall, as described in LVMC 11.68.040; or (J) Without displaying thereon the information and identification number described in Section 13.24.020. Las Vegas Municipal Code § 13.24.115 Installation—Placement.

13.24.115 - Installation—Placement. (A) A news rack may be affixed to a sidewalk by bolts or other similar means if: (1) The means of doing so is approved by the Director or is in accordance with a standard established by the Director; and (2) The installation is performed in a manner that does not disturb the integrity of the sidewalk and that will allow the news rack to be removed without damage to the sidewalk. (B) The person responsible for the placement of a news rack under this Section shall be responsible for any damage to the sidewalk that may remain after the news rack is removed and shall ensure that the sidewalk is restored to a safe and serviceable condition. Las Vegas Municipal Code § 13.24.120 Advertising—Cards.

13.24.120 - Advertising—Cards. No news rack shall be used for advertising or display purposes except that news rack cards may be used to advertise the publication sold therein and the name of the publication may appear on the display window. (Ord. 1843 § 1 (part), 1976: prior code § 9-12A-4(F))

Las Vegas Municipal Code § 13.24.130 Maintenance.

13.24.130 - Maintenance. (A) Each news rack shall be maintained in a clean, neat and attractive condition and in good repair at all times, and shall be free from graffiti, rust, broken parts, litter, sharp edges, and chipped or peeling surfaces. (B) All publications shall be contained within the enclosed container portion of a news rack. No publication or other material shall be placed on top of or under the news rack or fastened to the outside of the news rack in any manner. No more than one publication may be displayed or made available within any news rack other than a multi-pocket news rack. Any violation of this Subsection may be immediately corrected by the Director of Public Works or his agent. (Ord. 5110 § 13, 1998: Ord. 1843 § 1 (part), 1976: prior code § 9-12A-4(G))

Las Vegas Municipal Code § 13.24.135 Change in status or information.

13.24.135 - Change in status or information. It shall be the ongoing responsibility of each news rack to notify the Director, in advance, of any change in the status or information described in Sections 13.24.083(B) and 13.24.200(B). The Director may take appropriate action to withhold action, to deny or to rescind previous approval action if the change in status or information would disqualify or prohibit the news rack under the provisions of this Chapter or the allocation of news rack locations thereunder.
