Imposition of impact fees.
Denver Revised Municipal Code § 50-53
in effectSec. 50-53. - Imposition of impact fees.
Impact fees are hereby imposed on development within the gateway area, for which building permits are or were applied for after October 23, 2000, to finance construction of capital improvements as set forth in the gateway infrastructure financing study and the capital improvements program.
(1) No building permit shall be issued to a property owner or a representative thereof for a development in a designated development subarea in the gateway area unless any impact fees due hereunder are calculated and collected pursuant to this article III.
(2) Impact fees shall not exceed the cost of providing capital improvements, the need for which is reasonably attributable to developments of property owners who pay the impact fees. Through agreement, impact fees may be financed and provided by other governmental or quasi-governmental entities or enterprises, or other entities. The impact fees shall be spent on new or enlarged capital improvements that reasonably benefit the property owners who pay the impact fees.
(3) That portion of impact fee revenues reasonably attributable to the equitable assessment described in subsection (2) of this section 50-54 may be spent on that portion of new or enlarged capital improvements that will reasonably benefit those property owners who have paid the impact fees even though the capital improvements may be sized in anticipation of future development.
(4) Subject to the provisions hereof, impact fees that are assessed against property owners shall be assessed in such a manner so that the property owners of new developments having the same impacts on capital improvements shall be assessed the same impact fees for those improvements.
(5) The impact fees shall be assessed against the parcel of real property on which the building is to be sited. In the event that impact fees owed for development are not paid as provided in subsection (1) of this section 50-53 or are not paid within thirty (30) days after billing has been sent to the property owner, a lien may be assessed against the property. To initiate such a lien, a statement of said lien, including the amount owed, shall be certified to the manager of finance, who shall record a notice of such lien with the clerk and recorder. The manager of finance shall assess and charge the same against the property involved, and collect the same due, plus interest thereon, in the manner as are delinquent real property taxes. If the lien remains unsatisfied, the manager of finance shall sell the property involved in the manner prescribed for sales of property for delinquent property taxes. The lien created thereby shall be superior and prior to all other liens, regardless of their dates or recordation, except liens for general taxes and special assessments. In addition to the remedies set forth herein, an action or other process provided by law may be maintained by the city to recover or collect any amounts, including interest, owing under this provision. The city reserves the right to withhold or revoke any building permit of any applicant who is delinquent in payment of the impact fees.
(6) Unless an agreement is in effect with a governmental, quasi-governmental or other entity, impact fees shall be paid to the city by cash or certified funds at the time of issuance of a building permit.
