Establishment of development subareas.
Denver Revised Municipal Code § 50-54
in effectSec. 50-54. - Establishment of development subareas.
Development subareas for each type of capital improvements for which impact fees are imposed are hereby established as shown on the development subarea maps which are addenda to the capital improvements plan.
(1) Such development subareas are established consistent with facility service areas established in the gateway infrastructure financing study for each capital improvement. Such areas provide a nexus between those property owners paying the impact fees and benefits received to ensure that those property owners paying impact fees receive substantial benefits from the public improvements financed by those impact fees.
(2) Additional development subareas or combinations of development subareas may be designated by council, by further ordinance, with consideration of the following factors in determining when and whether to add development subareas:
a. The Denver comprehensive plan.
b. Any standards for adequate public facilities incorporated in the capital improvements program.
c. The projected full development in the proposed development subarea as permitted by the zoning ordinances and the timing of such development.
d. The need for and cost of unprogrammed capital improvements necessary to support projected development.
e. Such other factors as council may deem relevant.
The principal reason for identifying a development subarea or combination of development areas is to ensure that development subareas projected to experience significant development in the future will be served adequately by necessary capital improvements.
