Oklahoma City Municipal Code § 5-10 Certificate of zoning and code compliance, conditional certificates.
§ 5-10. - Certificate of zoning and code compliance, conditional certificates.
(a) Every applicant for an original license in which the applicant proposes to locate the applicant's principal place of business under the license within the corporate limits of the City, except applicants for an employee, charitable event, special event or airline/railroad beverage license shall apply to the Supervisor of Licenses for:
(1) A certificate of zoning certifying that the applicant's proposed location and use thereof comply with all municipal zoning ordinances if applicable;
(2) A certificate certifying that the applicant's existing or proposed operations under the license comply with all municipal fire codes, safety codes, or health codes, if applicable;
(b) The certificates of compliance or noncompliance required by paragraphs (1) and (2) of subsection (a) of this section shall be signed by the Supervisor of Licenses or designee. Applications for such certificates shall be in writing and shall contain information in such detail as the Supervisor of Licenses may reasonably require describing the location and nature of operations to be conducted under the license. The Supervisor of Licenses shall be required to act on all applications for such certificates within 20 days of receipt of the written application.
(c) The Supervisor of Licenses may grant conditional certificates for premises proposed for licensed operations for which construction, modification or alteration is not completed. Conditional certificates shall indicate that the proposed premises will comply with the municipal zoning, fire, safety and health codes. The granting of conditional certificates shall not relieve the applicant of the duty of obtaining the certificates required by paragraphs (1) and (2) of subsection (a) of this section after completion of the construction, modification, or alteration. The Supervisor of Licenses shall issue the certificates required by paragraphs (1) and (2) of subsection (a) of this section within ten days after all final inspections are completed.
(d) If a licensee thereafter fails to maintain compliance with municipal zoning ordinances or fire, safety and health codes, the City Manager or designee shall notify the ABLE Commission promptly in writing setting forth details of the noncompliance.
