San José Municipal Code § 20.120.200
in effectWhen the council finds, determines, and declares that an ordinance is an urgency measure for the immediate preservation of the public peace, health, or safety, it may adopt such ordinance, effective immediately, without first referring the ordinance to the planning commission for its report or recommendation, and without itself first holding a public hearing.
