**ORDINANCE ESTABLISHING PROCEDURE FOR APPROVAL OF MURALS WITHIN THE CITY OF PHILADELPHIA**
BE IT ORDAINED BY THE MAYOR AND BOARD OF ALDERMAN OF THE CITY
OF PHILADELPHIA, Neshoba County, Mississippi, as follows:
**SECTION 1.**
**PURPOSE.** The purpose of this Ordinance is to protect, preserve, enhance and perpetuate those aspects of the City having historical, cultural, architectural and archaeological merit. Such activities will promote and protect the health, safety, prosperity, education and general welfare of the people living in and visiting Philadelphia, Mississippi.
**SECTION 2.**
**DEFINITION.** For the purpose of this Ordinance, the following definitions shall apply:
“MURAL” - Shall mean any piece of artwork painted directly on the outside of any side of any building, wall, ceiling, shed, roof or other large permanent surface or structure located within the City of Philadelphia, Mississippi, which contains lettering, graphics scenes, portraits or other objects depicted either by drawing, paintings, displays or other means.
“DISTRICT” - Shall mean the geographical boundaries of the City of Philadelphia, Mississippi. A copy of the plat of the City of Philadelphia can be found in City Hall located at 525 Main Street, Philadelphia, Mississippi 39350.
**SECTION 3.**
**APPLICATION.** Any new Murals beginning from the effective date of this Ordinance to be placed in the City of Philadelphia must be made by application by preparation of a Mural application form on file in the Office of the City Clerk at City Hall in the City of Philadelphia, Mississippi, 525 Main Street, Philadelphia, Mississippi 39350. Telephone (601) 656-3612. Once the application is made the City Building Official shall review the application and should it be in Order he may approve same or bring said application before the Board of Aldermen for their consideration. The City Building Official shall have thirty (30) days to review any application submitted and either approve or bring
before the Mayor and Board of Alderman at the next scheduled board meeting following the end of the thirty day period. Upon placement on the Agenda of the Board of Alderman, the Board shall either approve, deny or table said application. However, in no event shall an application not be acted upon by the Board of Aldermen for the City of Philadelphia for a period of more than sixty (60) days from the date of application.
SECTION 4.
**REQUIREMENTS.** The application for approval of the Mural shall require a full color rendering or sketches of the proposed Mural; a biography on the artist or artists and/or any additional and relevant information needed in order to consider the Mural application. The application form will be maintained and available in the Office of the City Clerk for the City of Philadelphia at City Hall located at 525 Main Street, Philadelphia, Mississippi 39350. The Board of Alderman shall have the right to reject any application should it be found to be contrary to the health, safety and welfare of the Citizens of the City of Philadelphia. It is the intention of the Board of Alderman to continue with the historical and artistic theme of the current murals existing. Thus, no mural shall be approved which is sexually explicit, depicting illegal material, prejudicial in nature, or is otherwise obscene, unsightly or does not enhance the historical and/or artistic nature of the City of Philadelphia.
SECTION 5.
**VIOLATION.** Should the owner or occupant of property fail to obtain a Mural approval from the City of Philadelphia, or should the Mural as constructed, painted, or developed not comply with the Mural Application and approval process in the information provided to the City as set forth in this Ordinance, then in such event, the Building Official for the City of Philadelphia or his designee, shall notify the owner or occupant of the property upon which the Mural is being erected notifying them of the non-compliance of the Mural with the application approval process set forth herein above.
SECTION 6.
**PENALTY.** Anyone violating any provisions of this Ordinance shall upon conviction be fined in an amount not to exceed Five Hundred and 00/100ths Dollars ($500.00) and/or confinement in jail for a term not exceeding six (6) months or both in addition to the penalty set forth herein the Municipal Court is hereby authorized to order the removal of said Mural and to access to the violator as part of the costs in this matter, the costs of the removal of same.
SECTION 7.
**CONFLICT.** All ordinances heretofore adopted on a subject which are in conflict herewith are hereby repealed and the application of this Ordinance will not be contrary to the public interest. No variance from the strict application fo any provisions shall be
granted.
SECTION 8.
**EFFECTIVE DATE.** This ordinance shall be in full force and effect one (1) month from and after its passage.
The foregoing Ordinance having been reduced to writing and having been read and considered by Section and then as a whole, Alderman, Justin Clearman moved to adopt same and seconded by Alderman James Tatum the motion to adopt the Ordinance, and the Mayor having called the question to vote, was recorded as follows:

The Motion having received the affirmative vote of all Alderman present, the Mayor declared the same carried.
The Mayor declared the Motion to have been carried and the Ordinance to have been adopted and directed the publication thereof.
