Continuation of existing operations pending ruling on applications; executive director to investigate applicants; time for making recommendation on application; new application not barred by recommendation of denial of application.

in effectProvided that it files a complete application pursuant to this chapter and pays all application fees by January 1, 1991, any cruise vessel lawfully operating pursuant to Chapter 109, Title 27, Mississippi Code of 1972, on July 1, 1990, may continue to operate until the commission determines whether to approve or deny the application under the provisions of this chapter or regulations adopted by the commission. Within a reasonable time after filing of an application and such supplemental information as the commission or the executive director may require, the executive director shall commence the investigation of the applicant and shall conduct such proceedings in accordance with applicable regulations as the commission may deem necessary. If a person has applied for a position which cannot be held pending licensure or approval by the commission, the executive director shall use his best efforts to make a recommendation to the commission concerning the application not longer than nine (9) months after the application and supporting data are completed and filed with the executive director. If denial of the application is recommended, the executive director shall prepare and file with the commission a written report of reasons upon which the recommendation is based. A recommendation of denial of an application is without prejudice to a new and different application if made in conformity to regulations applicable to such situations.
