2.50.010 - Suspension of commissioners permitted when. Any member of the City Council who is indicted for any felony by any grand jury of competent jurisdiction may be suspended from office by the Board, pending the outcome of such indictment, after a hearing and a majority vote as set forth in this Article. 2.50.020 - Suspension of elected officials permitted when. 2.50.030 - Hearing—Required upon indictment—Procedure generally. (A) Upon an indictment being issued against any member of the Board or other elected official of the City, the Board shall hold an administrative hearing in regard to the official so indicted concerning the nature of the conduct of the official which resulted in the indictment. (B) The hearing shall be closed upon the request of the officer who is prosecuting the indictment or in the discretion of the Board when to do otherwise would jeopardize the proceedings on the indictment in a court of law. (C) Testimony shall be taken and other evidence may be examined, and the rules pertaining to administrative law shall be followed. 2.50.040 - Hearing—Notice—Scheduling. The official so indicted shall be duly notified that a hearing shall take place upon a certain date and time. He shall be further advised as to the purpose of the hearing in such notice. Upon service of such notice, a hearing shall be held not less than ten days nor more than sixty days thereafter. 2.50.050 - Hearing—Conduct—Compelling witnesses. (A) The City Attorney shall conduct the proceedings of the hearing and may call any witness and produce any evidence necessary to benefit the Board in its deliberations. Each member of the Board may inquire of any witness about any of the evidence and of the official indicted. (B) The City Attorney, the Board and the official so indicted are each entitled to such process as is necessary to enforce the attendance of witnesses. 2.50.060 - Hearing—Official's appearance—Admissions or noncooperation. (A) The official so indicted shall appear at the time stated in the notice and shall answer all inquiries of him and may inquire of all witnesses, comment about any of the evidence and give any explanation he may wish in regard to any of the issues before the Board. (B) If the official pleads the truth of the allegations of the indictment or refuses to answer questions relevant to the issues, the Board may take such pleading or lack of cooperation into consideration. Las Vegas Municipal Code § 2.50.070 Decision on suspension—Appeal—Filling office.

2.50.070 - Decision on suspension—Appeal—Filling office. After all of the evidence has been taken, by testimony or otherwise, and after all of the statements and arguments of the City Attorney, the Board and the official so indicted have been considered, the Board shall make a determination, in the light of the evidence and in consideration of the interests of the public and the welfare of the government, whether or not such official should be suspended from office pending the outcome of the indictment. An appeal from a decision to suspend such official may be taken to an appropriate court, but, until such decision by the Board is reversed, the official shall remain suspended from his office. Upon such suspension and pending any appeal by the suspended official in connection therewith and the outcome of the indictment, if such suspension is sustained on appeal, the office may be filled temporarily as in a case of a vacancy. Las Vegas Municipal Code § 2.50.080 Conviction—Acquittal.

2.50.080 - Conviction—Acquittal. If the official so indicted is ultimately found guilty of the charges against him, the Board shall declare the office to which the official was elected vacant, in the manner prescribed in NRS 283.040. If such official is acquitted of the charges against him, his suspension shall be terminated and he may forthwith take office for the remainder of his term. If his position has been filled by a temporary appointment, as provided in Section 2.50.070, the person who holds the office by virtue of such temporary appointment shall relinquish the office upon the elected official's return to his original capacity. Las Vegas Municipal Code § 2.50.090 Salary of official and replacement.

2.50.090 - Salary of official and replacement. The salary paid to the said official shall be withheld from him during his suspension and shall be placed into a trust account pending the outcome of the indictment. If such official is acquitted, the money shall be paid immediately to him. If he is found guilty, however, the money shall revert to the City. In the event his office during such suspension has been filled temporarily, as provided in Section 2.50.070, the person who fills such office shall receive the salary established for the office without regard to the salary which is concurrently being paid into the trust account.
