Denver Revised Municipal Code § 18-101 Deputy sheriff major, deputy sheriff division chief, and sheriff pay plans.

Sec. 18-101. - Deputy sheriff major, deputy sheriff division chief, and sheriff pay plans. Denver Revised Municipal Code § 18-102 Longevity pay.

Sec. 18-102. - Longevity pay. (a) Effective January 1, 2022, deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff, upon reaching their third anniversary date of employment, shall be paid longevity pay at the rate of seven dollars ($7.00) per month for each year of service except that no employee shall receive longevity compensation in excess of one hundred seventy-five dollars ($175.00) per month or two thousand one hundred dollars ($2,100.00) per year. (b) Effective January 1, 2023, deputy sheriff majors, deputy sheriff division chiefs, and the sheriff, upon reaching their third anniversary date of employment, shall be paid longevity pay at the rate of ten dollars ($10.00) per month for each year of service. Denver Revised Municipal Code § 18-103 Insurance program.

Sec. 18-103. - Insurance program. Deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff shall receive insurance coverage under those programs in chapter 18, article VI of the Denver Revised Municipal Code, except that the city shall provide each employee a group life insurance benefit of two (2) times the employee's annual salary, up to a maximum of four hundred thousand dollars ($400,000.00) and a double-indemnity benefit for accidental death and dismemberment, subject to the provisions and limitations contained in the contract between the city and the insurance carrier and to such requirements and conditions as the health committee may from time to time establish. Employees may voluntarily participate, at the employee's cost, with no contribution by the city, in the deferred compensation program, the FLEX cash program, vision plan, supplemental life insurance plan, voluntary short term disability plan, and voluntary accidental death and dismemberment insurance, as long as these programs or plans are offered to the other deputy sheriffs. Denver Revised Municipal Code § 18-104 Vacation leave.

Sec. 18-104. - Vacation leave. (a) Effective January 1, 2008: (1) Eligible deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff shall receive eight (8) hours of vacation leave for each full calendar month of service with the city, for the first five (5) years of service within the career service. (2) Eligible deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff shall receive ten (10) hours of vacation leave for each full calendar month of service with the city for the sixth through the tenth consecutive year of service within the career service. (3) Eligible deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff shall receive twelve (12) hours of vacation leave for each full calendar month of service for the eleventh through the fifteenth consecutive years of service within the career service. (4) After the completion of fifteen (15) consecutive years of service, eligible deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff all employees shall receive fourteen (14) hours of vacation leave for each full month of service within the career service. (b) Credits for less than a full month of service. Deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff in a full-time position who work less than a full calendar month shall receive prorated vacation leave in accordance with the following schedule based on a pay period: (1) Under forty (40) hours—No vacation leave. (2) Forty (40) through fifty-nine (59) hours—Half of vacation leave authorized by subsections (a)(1) through (a)(4) of this section. (3) Sixty (60) through seventy-nine (79) hours—Three-fourths of vacation leave authorized by subsections (a)(1) through (a)(4) of this section. (4) Eighty (80) hours or more—Entire amount of vacation leave authorized by subsections (a)(1) through (a)(4) of this section. (c) Maximum. A maximum of two hundred eighty-eight (288) hours of vacation leave is accruable to an employee who has up to ten (10) years of service within the career service, and three hundred thirty-six (336) hours of vacation leave to an employee who has ten (10) or more years of service within the career service. (d) Granting vacation leave. The appointing authority shall grant vacation leave in accordance with the following provisions: (1) Vacation leave shall be granted only to deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff who have been deputy sheriffs continuously for at least six (6) months. (2) Vacation leave shall be granted each calendar year unless the appointing authority defers a deputy sheriff major's, a deputy sheriff division chief's, or the undersheriff's vacation leave because of unusual work requirements. An employee's vacation shall not be deferred to the extent that vacation leave credits are lost. (3) Vacation leave shall not be granted in advance of accrual. (e) Transfer of vacation leave credits. If a deputy sheriff major, deputy sheriff division chief, or the undersheriff transfers from one (1) agency or classification to another agency or classification within the career service, vacation leave shall be transferred with the employee and the accrued vacation time shall include the continuous length of service accumulated in another agency and classification within the career service. Denver Revised Municipal Code § 18-105 Sick leave.

Sec. 18-105. - Sick leave. (a) Crediting sick leave. Deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff working full time shall accrue sick leave at the rate of eight (8) hours per month of service within the career service, and those employees working part time shall accrue a proportionate amount. (b) Accruing and conversion of sick leave: Sick leave may be accumulated to a limit of nine hundred sixty (960) hours. When the accumulation exceeds eight hundred eighty (880) working hours, deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff shall be granted eight (8) hours of vacation leave or eight (8) hours at straight time pay for each eight-hour day of sick leave accumulated beyond eight hundred eighty (880) hours up to a limit of ninety-six (96) hours a year, in addition to the vacation leave to which the employee is otherwise entitled. (c) Payment upon separation: (1) Upon separation for any reason other than termination for cause, death, or retirement, a deputy sheriff major, deputy sheriff division chief, or the undersheriff who has completed five (5) consecutive years of service shall be paid at the regular rate of pay for the difference between the balance of sick leave days to his or her credit and forty (40) hours multiplied by the years of service to a maximum of ten (10) years. (2) Upon separation due to retirement or death, a deputy sheriff major, deputy sheriff division chief, or the undersheriff shall be paid at his or her regular rate of pay for one-half (½) of all accumulated sick leave credits existing on the effective date of retirement or death, or for the difference between the balance of sick leave days to his or her credit and thirty-six (36) hours multiplied by the years of service to a maximum of ten (10) years, whichever is higher, but not to exceed six hundred (600) working hours. (d) Granting sick leave: The appointing authority shall grant sick leave pay in accordance with the following provisions: (1) Sick leave shall not be granted in advance of accrual. (2) Leave without pay may be granted for sickness extending beyond the earned credits. (3) After six (6) continuous months of service, vacation leave credits may be used for sick leave when sick leave has been exhausted. (e) Sick leave for family care: (1) Sick leave may be used when a deputy sheriff major, deputy sheriff division chief, or the undersheriff is incapacitated by sickness or injury; for disabilities caused or contributed to by pregnancy, miscarriage, abortion, childbirth, and recovery therefrom; for medical, dental or optical examination or treatment, including examinations for military service or disability payments; or for necessary care and attendance during sickness of a member of the employee's immediate family. Immediate family includes husband, wife, son, daughter, mother, father, sister, brother, grandmother, grandfather, grandchildren, son-in-law, daughter-in-law, mother-in-law, father-in-law, brother-in-law and sister-in-law, and domestic partner as defined by the city. (2) The amount of sick leave granted for necessary care of the employee's immediate family shall not exceed eighty (80) work hours in any twelve-month period. Nothing in this paragraph shall limit the amount of unpaid leave which can be taken by an employee when federal law provides for such leave. (f) Debiting sick leave: Sick leave shall be debited as follows: (1) The amount of sick leave to be debited shall be computed on the basis of the exact number of half hours the employee is scheduled to work when leave is utilized. (2) Holidays or other regular days off shall not be counted in debiting sick leave. (3) Sick leave shall be debited in no less than one-half-hour units. (g) Effect of transfer on sick leave credits: When a deputy sheriff major, deputy sheriff division chief, or the undersheriff transfers from one (1) agency or classification within the career service to another, the sick leave credits shall be transferred with the employee. Denver Revised Municipal Code § 18-106 Designation of holidays.

Sec. 18-106. - Designation of holidays. Deputy sheriff majors, deputy sheriff division chiefs, and the sheriff shall receive eight (8) hours of holiday leave on the following days: (1) New Year's Day (January 1); (2) Dr. Martin Luther King, Jr. Day (third Monday in January); (3) Presidents' Day (third Monday in February); (4) Cesar Chavez Day (last Monday in March); (5) Memorial Day (last Monday in May); (6) Juneteenth (June 19); (7) Independence Day (July 4); (8) Labor Day (first Monday in September); (9) Veteran's Day (November 11); (10) Thanksgiving Day (fourth Thursday in November); (11) Christmas Day (December 25); and (12) Personal holiday (on a date chosen by the employee under procedures approved by the sheriff, or in the case of the sheriff, the manager of safety). Denver Revised Municipal Code § 18-107 Jury and court leave.

Sec. 18-107. - Jury and court leave. A deputy sheriff major, deputy sheriff division chief, or undersheriff who is required to serve as juror in a federal, state or municipal court shall be granted jury leave with full pay to serve in that capacity except that the employee shall pay to the city any jury fees he or she receives for such service. An employee who is subpoenaed to testify concerning matters arising out of the performance of his or her duties shall be granted court leave with full pay to serve in that capacity. (Ord. Denver Revised Municipal Code § 18-108 Funeral leave.

Sec. 18-108. - Funeral leave. Effective January 1, 2003, a deputy sheriff major, deputy sheriff division chief, or the undersheriff may be granted up to three (3) days funeral leave per year in the event of the death of a member of his or her immediate family. Immediate family includes husband, wife, son, daughter, mother, father, sister, brother, grandmother, grandfather, grandchildren, stepfather, stepmother, son-in-law, daughter-in-law, mother-in-law, father-in-law, brother-in-law, sister-in-law, and domestic partner as defined by the city. Funeral leave shall not be cumulative from year to year. (Ord. No. 959-05, § 1, 12-19-05)

Denver Revised Municipal Code § 18-109 Military leave.

Sec. 18-109. - Military leave. Eligible deputy sheriff majors, deputy sheriff division chiefs, or the undersheriff who are required to attend annual military training exercises with the United States government or any political subdivision thereof shall be granted at least one (1) and up to fifteen (15) days military leave in increments of one (1) to fifteen (15) days or any multiple thereof totaling fifteen (15) days. An employee who has requested but is not required to attend military training exercises may attend if the appointing authority grants military leave. (Ord. No. 959-05, § 1, 12-19-05)

Denver Revised Municipal Code § 18-110 Uniform maintenance and weapons allowance.

Sec. 18-110. - Uniform maintenance and weapons allowance. An annual allowance shall be paid to deputy sheriff majors, deputy sheriff division chiefs, and the sheriff for the maintenance of uniforms. This payment shall be made at the end of each calendar year. Upon separation other than for cause, this payment shall be prorated for the number of months served during the calendar year. Effective January 1, 2023, the amount of the annual allowance shall be seven hundred fifty dollars ($750.00). All employees hired on or after January 1, 2024 shall receive an allowance of up to one thousand dollars ($1,000.00) toward the cost of purchasing a weapon from the list of duty weapons approved by the department. Such payment shall be made within thirty (30) days after the employee presents the department with written proof of purchase of the weapon. Upon separation from employment, any employee who received this allowance will retain the weapon they purchased, and shall reimburse the City in accordance with the following proration schedule: (1) If employed by the department for less than one (1) year: 100% of the weapon allowance amount paid by the city; (2) If employed by the department for less than two (2) years: 80% of the weapon allowance amount paid by the city; (3) If employed by the department for less than three (3) years: 60% of the weapon allowance amount paid by the city; (4) If employed by the department for less than four (4) years: 40% of the weapon allowance amount paid by the city; (5) If employed by the department for less than five (5) years: 20% of the weapon allowance amount paid by the city; and (6) If employed by the department for five (5) or more years: no reimbursement required. Denver Revised Municipal Code § 18-111 Job-related injury policy.

Sec. 18-111. - Job-related injury policy. Effective January 1, 2003, the provisions of division 4 of article V of this chapter shall apply with regard to job-related injury leave notwithstanding the provisions of section 18-151(3)d.; except that a deputy sheriff major, deputy sheriff division chief, or the undersheriff shall be granted such leave at his or her full salary for a period not to exceed one hundred eighty (180) days which can be used over a period of eighteen (18) months immediately following the date of the occupational injury or occupational disease. If an employee who is on job-related injury leave, as described above, is not cleared to return back to duty by the city physician, after the one-hundred-eighty-day limit set above, the employee may use available vacation or sick leave. Denver Revised Municipal Code § 18-112 Computation of hourly rate for deputy sheriff command staff for purposes of calculating payments for accrued sick and vacation leave.

Sec. 18-112. - Computation of hourly rate for deputy sheriff command staff for purposes of calculating payments for accrued sick and vacation leave. For purposes of calculating payments for accrued sick and vacation leave, the hourly rate for deputy sheriff majors, deputy sheriff division chiefs, and the undersheriff shall be determined by adding the employee's annual salary and longevity pay and dividing that total annual figure by two thousand and eighty (2,080) hours. Denver Revised Municipal Code § 18-113 Survivor benefits.

Sec. 18-113. - Survivor benefits. In the event a deputy sheriff major, deputy sheriff division chief or the undersheriff is killed in the line of duty, the city shall provide medical and dental insurance coverage to the officer's surviving spouse and dependents for a period of one (1) year after the date of the officer's death, and the cost of such coverage will paid entirely by the city. Denver Revised Municipal Code § 18-114 Acting pay.

Sec. 18-114. - Acting pay. Effective January 1, 2016, a deputy sheriff division chief who, for a period of eight (8) consecutive work hours or more, is temporarily assigned to act as the sheriff shall be compensated at the rate of pay of the sheriff, in lieu of the salary of deputy sheriff division chief, for such time assigned to act as the sheriff; and, a deputy sheriff major who, for a period of eight (8) consecutive work hours or more, is temporarily assigned to act as a deputy sheriff division chief shall be compensated at the pay rate of deputy sheriff division chief, in lieu of the salary of deputy sheriff major, for such time assigned to act as a deputy sheriff division chief. Denver Revised Municipal Code § 18-115 Paid parental leave.

Sec. 18-115. - Paid parental leave. Effective January 1, 2025, birthing and adopting parents shall receive up to four (4) weeks of paid leave to care for their child immediately following the child's birth or adoption. Paid parental leave shall run concurrently with FMLA leave. To qualify for the leave, an employee must have been employed by the department for twelve (12) months prior to the use of paid parental leave. (Ord. No. 281-24, § 4, 3-26-24)
