Oklahoma City Municipal Code § 10-51 Compliance with law, rules, etc.

§ 10-51. - Compliance with law, rules, etc. All activities at airports in the Department which are of an aeronautical nature shall be conducted in conformity with the current pertinent provisions of the regulations issued by the Federal Aviation Administration and authorized orders issued by the Director and the provisions of this article which are not in conflict with the Federal Aviation Administration regulations. Oklahoma City Municipal Code § 10-52 Traffic patterns; runway rules.

§ 10-52. - Traffic patterns; runway rules. (a) Flight traffic patterns. All aircraft at any airport within the Department shall conform to the traffic patterns promulgated jointly by the Federal Aviation Administration and the Director for the airport in use, unless otherwise specifically authorized by the traffic control tower. (b) Runway traffic patterns. Rules for the use of aircraft on all runways at any airport in the Department, and the traffic patterns which shall be followed by all aircraft using such runways, shall be established jointly by the Director and the Federal Aviation Administration and supplemented where necessary or desirable by schematic drawings, maps or other visual devices to aid in clearly understanding such rules. Oklahoma City Municipal Code § 10-53 Temporary parking area for aircraft at Wiley Post Airport.

§ 10-53. - Temporary parking area for aircraft at Wiley Post Airport. (a) Public tiedown apron. The Director, by appropriate rule or regulation, shall designate an area at Wiley Post Airport as a public tiedown apron for the temporary parking of general aviation aircraft. (b) Fee levied for nighttime parking of aircraft. A fee is hereby authorized and is levied for the privilege of parking aircraft in the designated public tiedown area for a period exceeding three hours during any 12-hour period beginning at 6:00 p.m. and ending at 6:00 a.m., such 12-hour periods being designated as restricted time. The amount of such fee shall be as established in Chapter 60, the General Schedule of Fees. (c) Aircraft parking during restricted time prohibited and constituting a trespass. No person shall permit an aircraft within his control to be parked in the designated tiedown area for a period exceeding three hours during any restricted time unless the fee prescribed herein shall have been paid. Any aircraft remaining parked in the designated tiedown area for a period exceeding three hours during any restricted time shall be deemed to be a trespassing aircraft subject to impoundment unless the fee prescribed herein shall have been paid for such parking privilege. (d) Aircraft parking during restricted time on more than five consecutive days prohibited and constituting a trespass. No person shall permit an aircraft within his control to be parked in the designated tiedown area during the restricted time on more than five consecutive days, regardless of the payment of the fees prescribed herein. Further, regardless of the payment of prescribed fees, any aircraft remaining parked in the designated tiedown area on more than five consecutive days shall be deemed to be a trespassing aircraft subject to impoundment. (e) Director of Airports to post notices. The Director shall post notices at conspicuous places in and adjacent to the public tiedown apron advising the traveling public of the specific location of such apron and contents and requirements of this section. (f) Collection of nighttime parking fees. The fees levied under this section may be collected by any method as the Director and the Oklahoma City Airport Trust shall consider most convenient to the traveling public, the users of Wiley Post Airport and the Department. (g) Other regulations to be observed. The provisions of this section shall not relieve any person from the duty to observe and comply with other provisions of this chapter, including, by way of illustration but not of limitation, the prohibition against conducting an unauthorized commercial pursuit at any airport. Oklahoma City Municipal Code § 10-54 Impoundment.

§ 10-54. - Impoundment. (a) Aircraft to be removed upon demand; impoundment. Any trespassing aircraft and any abandoned, disabled or derelict aircraft or aircraft parts wrongfully or improperly left upon airport property shall be removed by the owner or operator at his own expense upon demand made by the Director. If after demand the owner or operator fails and refuses to remove the aircraft within a reasonable time as determined by the Director from either the circumstances and/or conditions of hazard created by reason of the presence of the aircraft, the Director shall cause the same to be impounded and stored in a place of safekeeping. (b) Release of impounded aircraft. The cost of removal and storage shall be a charge against the owner or operator of the aircraft; upon payment of the charge, the payment of nighttime parking fees due, if any, and the submission of the instruments required under Subsection (c), the impoundment shall be released upon written order of the Director and possession of the aircraft shall be restored to any party claiming an interest in the impounded aircraft. (c) Release; instruments to be filed. Any party claiming an interest in an impounded aircraft shall submit to the Director proof of compliance with the following requirements by written instruments or other suitable documents: (1) proof of interest. (2) agreement to save and hold harmless the City and the Oklahoma City Airport Trust and all their agents and employees. (3) any party seeking release of any aircraft, other than the registered owner thereof, shall submit proof of financial responsibility showing the net worth of such party to be in excess of double the value of the aircraft sought to be released or a surety bond in an amount no less than double the value of the aircraft sought to be released. Such instruments shall be approved as to form and legality by the Municipal Counselor or his designated assistant and filed by the Director with the City Clerk prior to or simultaneously with the release of the aircraft claimed together with a copy of the release order. Oklahoma City Municipal Code § 10-55 Guarding aircraft.

§ 10-55. - Guarding aircraft. When the kind, type, mission and condition of an aircraft makes it necessary, in the opinion of the owner, to provide security guards wherever the aircraft is located on the airport, the owner of the aircraft shall be responsible for obtaining, providing and maintaining his own security guards after permission to establish such security has been obtained from the Director or his duly authorized representative. Security requirements shall not be used as a means to hinder or delay removal of aircraft at the direction of the Director. (Code 1970, § 4-16; Code 1980, § 10-55; Ord. No. 18809, § 4, 7-21-87)

Oklahoma City Municipal Code § 10-56 Liability of owners or operators for airport damage.

§ 10-56. - Liability of owners or operators for airport damage. (a) Owner or operator of aircraft liable for damages. The owner or operator of any aircraft which by reason of any type of accident, crash, or fire, or which by reason of malfunction or operation, causes any damage to airport property shall be responsible to the City and the Oklahoma City Airport Trust for the damage. (b) Director to compute amount and make demand. The amount of damage shall be ascertained by the Director who shall make demand upon the owner or operator for payment thereof. (c) Legal action by Municipal Counselor. If the owner or operator fails or refuses to pay the amount of the claim for damages, a full report of the circumstances on which the claim is based, together with a copy of the claim, shall be turned over to the Municipal Counselor, who shall, when directed by the Council, institute in the name of the City all necessary legal proceedings for collection of the claim.
