Ordinance No. 575

## AN ORDINANCE ENTITLED "TO REGULATE THE DISCHARGE OF FIREARMS WITHIN THE CORPORATE BOUNDARIES OF THE CITY OF PHILADELPHIA, MISSISSIPPI; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ENFORCEMENT."

BE IT ORDAINED BY THE CITY OF PHILADELPHIA, MISSISSIPPI:

**SECTION I:** The Board of Mayor and Aldermen have determined that there exists within the corporate boundaries of the City of Philadelphia a situation potentially dangerous to the health, safety and well being of the citizens of said city in that there needs to be a regulation of the discharge of firearms within the municipal boundaries.

**SECTION II:** For purposes fo this ordinance firearm is defined as follows: any weapon which discharges a projectile through the combustion or explosion of gun powder or any other chemical or exterior substance excluding air.

**SECTION III:** Any person who shall be found guilty of discharging a firearm within the municipal boundaries of the City of Philadelphia, would, upon the conviction of same, be guilty of a misdemeanor and shall be punished as follows:

1). First offense, a fine of up to $500.00 or up to 30 days in jail, or both. 2). Second offence, a fine of up to $750.00 or up to 60 days in jail, or both. 3). Third offense or subsequent offense, a fine of up to $1,000.00 or up to 90 days in jail, or both.

There shall be excluded from this ordinance any law officer required to discharge a firearm in the course of duty and any individual acting in self defense.

**SECTION IV:** This Ordinance shall take effect and be in force from and after its passage and due

The above and foregoing ordinance was first reduced to writing, read and considered by sections, and read and considered as a whole and adopted with the following Aldermen voting as follows:
