AN ORDINANCE TO AMEND AN ORDINACE ENTITLED “AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES, AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND DENISTY OF POULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND ARE AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT.”

BE IT ORDAINED BY THE CITY OF PHILADELPHIA, MISSISSIPPI:

SECTION 1: That Ordinance Number 515, entitled, “AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES, AND SIZE OF BUILDINGS AND OTHER STRUCTURES, THE SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENISTY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR IT ENFORCEMENT,” Passed and adopted by the Mayor and Board of Alderman of the City of Philadelphia on the 20th day of October, 1987, approved on the 20th day of October, 1987, and recorded On pages 410 through 410, all inclusive, of Ordinance Book 3 of the City of Philadelphia, Mississippi, be and the same is hereby amended by changing:

To remove the following described property, to-wit:

From the Northeast corner of the Northwest Quarter of Section 33, Township 11 North, Range 11, East, Neshoba County, Mississippi, run South 1 degrees 34 minutes West for 840.2 feet to the point of Beginning of the following described parcel of land. From said point of beginning, run South 1 degree and 34 minutes West for 210.0 feet to a point on the Northern side of the 100 feet wide right-of- way for Mississippi Highway 16; thence North 77 degrees and 28 minutes West along said right-of-way for 351.69 feet; thence North 11 degrees and 51 minutes East for 209.18 feet; thence South 77 degrees and 28 minutes East for 314.22 feet to the Point of Beginning. This parcel contains 1.57 acres situated in the Northeast Quarter of the Northwest Quarter of Section 33, Township 11 North, Range 11 East, City of Philadelphia, Neshoba County, Mississippi.

AND ALSO:

2.0 acres, more or less, located in the Northeast ¼ of the Northwest ¼ of Section 33, Township 11 North, Range 11 East, City of Philadelphia, Neshoba County, Mississippi, and being further described as follows:

Commence at a found ½" rebar located at the Northeast corner of the Northeast ¼ Of the Northwest ¼ of Section 33, Township 11 North, Range 11 East; Neshoba County, Mississippi. Thence South 01°31'53" West 495.63 feet to a ½ rebar, said point also being the POINT OF BEGINNING; thence South 01°31'53" West 344.63 feet to a found ½ rebar; thence North 77°28'00" West 253.03 feet to a found ½" rebar; thence North 346.56 feet to a ½" rebar; thence South 77°28'00" East 262.47 feet to a ½" rebar and the POINT OF BEGINNING.

From Residential to Zone C-3. SECTION II. This Ordinance shall take effect and be in force from and after its passage and due publication. The above and foregoing Ordinance was first reduced to writing, read and considerations, by sections, and read and considered as a whole and adopted with the following Alderman voting as follows: Alderwoman Janice Payne voted aye Alderman Joe Tullos voted aye Alderman Roy White voted Recused Alderman Ronnie Jenkins voted aye Alderwoman Bobbie Jackson voted aye

This Ordinance was declared and adopted by the Mayor, Rayburn Waddell, on this the 20th day of May, 2008.
