Ordinance No. 720

AN ORDINANCE ENTITLED AN ORDINANCE TO REGULATE AND CONTROL DISTRIBUTION OF UNSOLICITED AND UN-SUBSCRIBED TO ADVERTISING MATERIALS WITHIN THE CITY OF PHILADELPHIA, MISSISSIPPI

WHEREAS, it has come to the attention of the Mayor and Board of Aldermen of the City of Philadelphia, Mississippi that there is being distributed within the corporate boundaries of the City advertising materials that are not requested nor subscribed to; that said materials are being thrown on driveways, yards and even public streets without permission of any party; and,

WHEREAS, citizens of the City of Philadelphia have expressed to the Board, both their concern and dissatisfaction over the distribution of this material as it creates a nuisance and constitutes a problem of littering.

BE IT THEREFORE ORDAINED BY THE BOARD OF MAYOR AND ALDERMEN OF THE CITY OF PHILADELPHIA, MISSISSIPPI, that any random distribution of advertising material which is unsolicited and un-subscribed to that is thrown or placed on driveways, private property or on public streets shall be prohibited.

A. Any person who shall be caught distributing such material as hereinabove set forth shall be charged with a violation of this Ordinance and littering. If found guilty of a violation of this Ordinance or found guilty of littering, any such person shall be fined up to $500.00 per incident and/or up to thirty (30) days in jail per incident, or both.

B. The owner or manager of any business who permits the distribution of such material and who is charged and found guilty of permitting such distribution is subject to being fined up to $500.00 per incident and/or up to thirty (30) days in jail per incident, or both.

This Ordinance having first been reduced to writing and read in its entirety, and having been considered by the Board, there was received a Motion by Janice Payne, and a second by Joe Tullos, to approve this Ordinance and the Board voted as follows:

The Mayor declared the Ordinance passed and same shall become effective after publication as required by law.
