AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED "AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, AND SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE, AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT."
BE IT ORDAINED BY THE CITY OF PHILADELPHIA, MISSISSIPPI:
SECTION I: That Ordinance Number 515, entitled "An Ordinance to regulate and restrict the location and use of buildings, structures, and land for trade, industry, residence, or other purposes, the weight, number of stories, and size of buildings and other structures, the size of yards and other open spaces, off-street parking and loading, and the density of population; and for said purposes to divide the municipality into districts of such number, shape, and area as may be deemed best suited to carry out these regulations; to prescribe penalties for the violation of its provisions and to provide for its enforcement," passed and adopted by the Board of Mayor and Alderman of the City of Philadelphia, on the 5th day of August ,2014, approved on the 5th day of August ,2014, and recorded on pages 55 through 56, all inclusive, of Ordinance Book 5 of the City of Philadelphia, Mississippi, be and the same is hereby amended by changing:
All that part of the SE 1/4 of SE 1/4 South and West of Highway, less and except Billy Burrage Tract, Section 34, Township 11 North, Range 11 East, containing 3.9 acres, more or less.
And also all that part of the NE 1/4 of NE 1/4, Section 3, Township 10 North, Range 11 East, West of Highway, less and except two acres described as follows:
Commence at the NE corner of Section 3, Township 10 North, Range 11 East, and run West 527.00 feet to a point on the Western R.O.W. of MS. Hwy. # 15 Bypass; thence run South 02 degrees 40 minutes East 546.60 feet along said R.O.W.; thence run South 17 degrees 42 minutes West 186.10 feet along said Western R.O.W. to a concrete R.O.W. marker; thence run South 01 degrees 09
minutes West 471.53 feet along fence line on said Hwy. # 15 Bypass R.O.W.; thence run South 88 degrees 10 minutes West 126.00 feet along the Northern R.O.W. of high power line to and for the POINT OF BEGINNING; thence run North 23 degrees 00 minutes West 448.00 feet; thence run South 88 degrees 10 minutes West 210.00 feet; thence run South 23 degrees 00 minutes East 448.00 feet to a point on said power line R.O.W.; thence run North 88 degrees 10 minutes East 210.00 feet along said power line R.O.W. back to the POINT OF BEGINNING; containing 2.00 acres, more or less, and being located in the NE 1/4 of the NE 1/4, Section 3, Township 10 North, Range 11 East, Neshoba County, Mississippi,
from Zone R-1 to Zone C-3.
SECTION II: This Ordinance shall take effect and be in force from and after its passage and due publication.
The above and foregoing Ordinance was first reduced to writing, read and considered by sections, and read and considered as a whole and adopted with the following Aldermen voting as follows:
