AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED “AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, AND SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE, AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT.”

BE IT ORDAINED BY THE CITY OF PHILADELPHIA, MISSISSIPPI:

SECTION I: That Ordinance Number 515, entitled “An Ordinance to regulate and restrict the location and use of buildings, structures, and land for trade, industry, residence, or other purposes, the weight, number of stories, and size of buildings and other structures, the size of yards and other open spaces, off-street parking and loading, and the density of population; and for said purposes to divide the municipality into districts of such number, shape, and area as may be deemed best suited to carry out these regulations; to prescribe penalties for the violation of its provisions and to provide for its enforcement,” passed and adopted by the Mayor and Board of Aldermen of the City of Philadelphia, on the 20th day of October, 1987, approved on the 20th day of October, 1987, and recorded on pages 410 through 410, all inclusive, of Ordinance Book 4 of the City of Philadelphia, Mississippi, be and the same is hereby amended by changing:

Beginning 10 yards East of the Northwest corner of the NW ¼ of NE ¼ OF Section 25, Township 11 North, Range 11 East and run 91 2/3 yards South for starting point; thence on due South 55 feet; thence East 105 feet; thence North 55 feet; thence West 105 feet to the point of beginning in Section 25, Township 11 North, Range 11 East, and in NW ¼ of NE ¼ hereof.

From Zone R1 to R-3.

SECTION II: This Ordinance shall take effect and be in force from and after its passage and due publication.

The above and foregoing Ordinance was first reduced to writing, read and considered by sections, and read and considered as a whole and adopted with the following Aldermen voting as follows:

Beginning at the intersection of Rea Street and Fox Avenue and running South along the East side Fox Avenue, a distance of 125 feet for a point of beginning (point of beginning being the same as the Southwest corner of a lot owned by Mrs. Ivon McNair); thence South along the East side of Fox Avenue a distance of 100 feet; thence East a distance of 175 fee; thence North a distance of 100 feet; thence West a distance of 175 feet to the point of the beginning; all in Block 194 of the Stribling Addition of the City of Philadelphia.

From R-1 to R-2.

The East 40 feet of Lots 1 and 2 of Block X-47, and the West 40 feet of Lots 3 and 4, of Block X-50 of the A. J. Yates Addition to the City of Philadelphia, Neshoba County, Mississippi, according to the plat now filed in the Office of the Chancery Clerk of the County and State aforesaid.
