AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED “AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES, AND SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE, AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT.”

BE IT ORDAINED BY THE CITY OF PHILADELPHIA, MISSISSIPPI:

SECTION I: That Ordinance Number 515, entitled “An Ordinance to regulate and restrict the location and use of buildings, structures, and land for trade, industry, residence, or other purposes, the weight, number of stories, and size of buildings and other structures, the size of yards and other open spaces, off-street parking and loading, and the density of population; and for said purposes to divide the municipality into districts of such number, shape, and area as may be deemed best suited to carry out these regulations; to prescribe penalties for the violation of its provisions and to provide for its enforcement,” passed and adopted by the Mayor and Board of Aldermen of the City of Philadelphia, on the 20th day of October, 1987, approved on the 20th day of October, 1987, and recorded on pages 410 through 410, all inclusive, of Ordinance Book 4 of the City of Philadelphia, Mississippi, be and the same is hereby amended by changing:

Beginning at the Northwest corner of section 2, Township 10 North, Range 11 East, Neshoba County Mississippi and run due East 333.0 feet, to a corner on the West right-of-way line of Mississippi state highway no. 15; thence South 8 degrees 30 minutes West along said right-of-way line 184.0 feet; Thence South 88 degrees West 320.0 feet, to a fence; thence North 194.0 feet to the point of beginning, containing 1.36 acres in the Northwest ¼ of the Northwest ¼ of section 2, township 10 North, Range 11 East Neshoba County, Mississippi

From the NW corner of Section 2, Township 10 North, Range 11 East, run South 1 degree 28 minutes West along an old fence for 194 feet to the point of beginning, thence North 88 degree 00 minutes East for 312 feet to the West right of way of Mississippi highway 15; thence South 10 degree 47 minutes West along said right of way for 229 feet; thence run North 73 degrees 50 minutes West for 285 feet to said old fence; thence North 1 degree 24 minutes East a long said old fence for 137.1 feet to the point of beginning, containing 1,24 acres, more or less, and being situated in the NW1/4of NW1/4 of section 2 and a strip of land in the NE1/4 of NE1/4 of section 3 all being situated in the NW1/4 of NW1/4 of section 2 and a strip of land in the NE1/4 of NE1/4 section 3 all being situated in township 10 North, range 11 East, Neshoba County, Mississippi

From Zone R1 to C3.

SECTION II: This Ordinance shall take effect and be in force from and after its passage and due publication.

The above and foregoing Ordinance was first reduced to writing, read and considered by sections, and read and considered as a whole and adopted with the following Aldermen voting as follows:

Alderwoman James Tatum voted AYE Alderman Joe Tullos voted ABSENT Alderman Jim Fulton voted AYE Alderman Willie Jackson voted ABSENT Alderwoman Cecil Nichols voted AYE

This Ordinance was declared adopted by the Mayor and Board of Aldermen, on this the 17th day of January, 2017
