AN ORDINANCE TO AMEND AN ORDINANCE ENTITLED “AN ORDINANCE TO REGULATE AND RESTRICT THE LOCATION AND USE OF BUILDINGS, STRUCTURES, AND LAND FOR TRADE, INDUSTRY, RESIDENCE, OR OTHER PURPOSES, THE HEIGHT, NUMBER OF STORIES AND SIZE OF BUILDINGS AND OTHER STRUCTURES , AND SIZE OF YARDS AND OTHER OPEN SPACES, OFF-STREET PARKING AND LOADING, AND THE DENSITY OF POPULATION; AND FOR SAID PURPOSES TO DIVIDE THE MUNICIPALITY INTO DISTRICTS OF SUCH NUMBER, SHAPE, AND AREA AS MAY BE DEEMED BEST SUITED TO CARRY OUT THESE REGULATIONS; TO PRESCRIBE PENALTIES FOR THE VIOLATION OF ITS PROVISIONS AND TO PROVIDE FOR ITS ENFORCEMENT.”

BE IT ORDAINED BY THE CITY OF PHILADELPHIA, MISSISSIPPI:

SECTION I: That Ordinance Number 515, entitled “An Ordinance to regulate and restrict the location and use of buildings, structures, and land for trade, industry, residence, or other purposes, the weight, number of stories, and size of buildings and other structures, the size of yards and other open space, off-street parking and loading, and the density of population; and for said purposes to divide the municipality into districts of such number, shape, and area as may be deemed best suited to carry out these regulations; to prescribe penalties for the violation of its provisions and to provide for its enforcement, “ passed and adopted by the Board of Mayor and Alderman of the City of Philadelphia, on the 3rd of October, 2012, approved on the 3rd day of October, 2012, and recorded on page 38, all inclusive, of Ordinance Book 5 of the City of Philadelphia, Mississippi, be and the same is hereby amended by changing:

All That land lying west of Mississippi highway 15 by-pass in the following lands: beginning at the SW corner of section 35, township 11 north, range 11 east, Neshoba County, Mississippi, and run west 660 feet; thence north 01 degrees east 160 feet; thence north 67 degrees east 1183 feet; thence south 09 degrees west 636 feet; thence west 332.5 feet to the point of beginning. The above described properly being in the SE ¼ of SE ¼, section 34 and SW ¼ of SW ¼, section, all in township 11 north, range 11 east, containing .55 acres, more or less. Beginning on the section line between sections 24 and 25, township 11 north, range 11 east, where said line crosses the west right-of-way of the G.M.&O. Railroad and run west 66 2/3 yards to and fro point of beginning; thence on west 16 2/3 yards; thence north 86; thence east 16 2/3 thence south 86 yards to the point of east, and being in the SW ¼, of said section, township and range.

From Zone R-1 to Zone R-3.

SECTION II: This Ordinance shall take effect and be in force from and after its passage and due publication.

The above and foregoing Ordinance was first reduced to writing, read and considered by sections, and read and considered as a whole and adopted with the following Aldermen voting as follows:
