Ordinance No. 722

AN ORDINANCE ADOPTING A RESOLUTION AND PETITION TO EXTEND LEGAL HOURS FOR THE SALE OF LIQUOR AND WINE CONTAINING MORE THAN 5% ALCOHOL CONTENT BY WEIGHT

WHEREAS, the Mayor and Board of Aldermen of the City of Philadelphia, Mississippi acknowledge that the law on the hours of sale of liquor and wine with 5% or more alcohol at on-premise establishments is limited by State law; and,

WHEREAS, State law prohibits the sale of such liquor on Sunday and the Mayor and Board of Aldermen of the City of Philadelphia have determined that a special request is proper to the Mississippi State Tax Commission (Alcohol Beverage Control) under Title 35, requesting that on-premises sale be allowed to sell for consumption on its premises liquor on Sunday during the hours from 10:00 A.M. to midnight.

THEREFORE, be it ordained by the Mayor and Board of Aldermen of the City of Philadelphia that a Petition be filed with the State Tax Commission (Alcohol Beverage Control) requesting permission to grant Sunday sale of liquor at on-premise locations from the hours of 10:00 A.M. to midnight.

This Ordinance having first been reduced to writing and read in its entirety, and having been considered by the Board, there was received a Motion by ________________________, and a second by ________________________, to approve this Ordinance and the Board voted as follows:

PETITION

Come now, the Mayor and Board of Aldermen of the City of Philadelphia, Mississippi and respectfully petition the State Tax Commission (Alcohol Beverage Control) under Title 35, to grant an extension of hours to sell liquor and wines in restaurants and other such establishments on Sunday between the hours of 10:00 A.M. and midnight.

Attached to this Petition is a copy of Ordinance # 722 which authorizes the filing of this special request.
