Oklahoma City Municipal Code § 55-61 Scope.

§ 55-61. - Scope. The rates and charges provided for in this article shall apply without distinction as to whether the water system is being operated by the trustees of the Oklahoma City Water Utilities Trust or the City. (Code 1970, § 35-1(j); Code 1980, § 55-61; Ord. No. 19433, § 1, 6-26-90)

Oklahoma City Municipal Code § 55-62 Usage charges inside and outside City.

§ 55-62. - Usage charges inside and outside City. (a) There is hereby established a schedule of charges for all water delivered monthly through the meters of the water system of the City for use within the corporate limits of the City. The schedule of such charges shall be as established in Chapter 60, the General Schedule of Fees. From time to time, certain customer classes, rates, rate schedules, charges, and fees may be amended, revised, phased out, or merged with other schedules of charges. Less and except when a customer class, rate, rate schedule, charge or fee is amended, revised, phased out, or merged as provided in this Code or by amended of this Code, customers may not change customer classes, rates, rate schedules, charges and fees. Should a customer use or manipulate or attempt to use or manipulate the City water system to avoid being charged or to circumvent full cost recovery or reasonable cost allocation, then the Director may reassign a customer to a different customer class, rate, rate schedule, charge or fee to accomplish full cost recovery or reasonable cost allocation. In the event of force majeure as determined by the Director, the Director may, in the Director's sole discretion, adjust customer class, rates, rate schedules, charges or fees to accomplish full cost recovery or reasonable cost allocation. Force majeure as used herein shall mean a natural catastrophe or unavoidable event. (b) For all water delivered through City meters for use within and without the corporate limits, the user shall pay a quantity charge(s) for water delivered plus a monthly water customer service charge(s) based on the size of the water meter, known as a monthly water customer service charge (per meter), which shall be charged regardless of water usage or non-usage. The quantity charge(s) for water may include multiple components including, but not limited to, block rates, base rates, reservation rates, excess rates, peak-day rates, and peak-hour rates. (c) In addition to the charges in Subsection (b) above, there shall be additional charge(s) as established in Chapter 60, the General Schedule of Fees for any housekeeping unit in: (1) a mobile home park, (2) apartments, (3) any other multiple housekeeping unit structures, complexes, properties with three or more housekeeping units (less and except for hotels, motels, and wholesale customers) which do not have a separate meter for each housekeeping unit, and (4) other existing multiple residential unit service areas that are master metered, provided nothing herein authorized any new or additional master metered multiple residential unit service areas. (d) Housekeeping units charge. The City has established housekeeping unit charge(s) to recover certain costs, including but not limited to, the costs of notice, communication and administration of customer accounts with multiple (four or more) housekeeping units. (1) "housekeeping unit" charges are not levied for a single-family residential house, duplex or a triplex. (2) a "housekeeping unit," in the case of quadplexes or larger residential facilities such as apartments or any other multiple housekeeping unit structures (less and except for hotels, motels, and wholesale customers) each being a unit with kitchen facilities or privileges for family functions, each housekeeping unit structure with kitchen facilities or privileges for family functions shall be deemed a housekeeping unit. (3) a " housekeeping unit," in the case of mobile home parks, being each location or pad with a water hookup or where a water hookup is available or has in the past been made, whether said location or pad is occupied or unoccupied at the time of billing. (e) As used in this chapter and Chapter 60, the General Schedule of Fees, to determine applicable water rates: (1) "Average Winter Water Consumption" (AWC) shall be defined as the arithmetic average monthly water volume computed based upon the metered or estimated water usage on bills rendered during the months of December through February for a particular utility account. Provided, however, the Director at her/his discretion may use the March water usage bill as deemed necessary to establish the AWC. The AWC for each utility account will be recalculated each year and will be applicable to water usage charges in April and thereafter until a new AWC is established for that utility account. The AWC will be used to determine the applicable rate block per thousand-gallon water usage charge(s) for nonresidential utility accounts until the AWC is established for the customer as provided herein. In those instances when no or insufficient data for calculating the AWC for a particular utility account, the Customer Service Superintendent will determine the appropriate method of estimating the AWC for the utility account. In estimating the AWC, the Customer Service Superintendent may consider prior and subsequent volumes or usages, partial meter readings, pipe sizes, pumping capacities, water pressures, weather, number of water facilities, the number of occupants or water users, similar users and uses, and other relevant factors. (2) A "residential utility account" shall be defined as a utility account, as determined by the Customer Service Superintendent, to serve one or more housekeeping units. (3) A "nonresidential utility account" shall be defined as any utility account which is not a residential utility account. (f) Private fire service charges - Monthly. Customers with dedicated private fire lines will be charged monthly private fire service charges for service and service availability based upon the diameter (in inches) of each connection to the City water system in accordance with the applicable rate in Chapter 60, the General Schedule of Fees. Oklahoma City Municipal Code § 55-63 Water usage charge(s).

§ 55-63. - Water usage charge(s). There is hereby levied a schedule of rates, fees, and charges, and any amendment thereto, for all water and water services provided by the City. The schedule of such rates, fees and charges shall be as established in Chapter 60, the General Schedule of Fees. (a) Treated Water, Inside City, Oklahoma City water source. Inside City water customers who are connected to the water system of the City shall be deemed to have contracted for water service in accordance with this Code. (1) Treated Water, Inside City, Oklahoma City water source, retail residential service (Single Family, Duplex and Triplex). These customers will be charged and must pay monthly water customer service charge(s), plus water usage charge(s) (volume delivered is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. (2) Treated Water, Inside City, Oklahoma City water source, retail residential service (Multifamily). These customers will be charged and must pay monthly water customer service charge(s), plus water usage charge(s) (volume delivered is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. (3) Treated Water, Inside City, Oklahoma City water source, retail non-residential service (Commercial/Industrial). These customers will be charged and must pay monthly water customer service charge(s), plus water usage charge(s) (volume delivered is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. (4) Treated Water, Inside City, Oklahoma City water source, retail service, (Manufacturing customer). These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (5) Treated Water, Inside City, Oklahoma City water source, retail service (Irrigation only). These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (6) Treated Water, Inside City, Oklahoma City water source, retail service, (Flush meters). These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (7) Treated Water, Inside City, Oklahoma City water source, standby service (Tinker Air Force Base). These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (8) Treated Water, Inside City, Oklahoma City water source, continuous service (Tinker Air Force Base). These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. The continuous service rates and charges include the cost of providing treated water service including treatment, delivery up to the meters, meter costs, and account administration. Infrastructure on Tinker Air Force Base including distribution and maintenance costs are excluded from these continuous service rates and charges. (b) Treated Water, Outside City, Oklahoma City water source. Outside City water customers who request water for direct use (retail) or further delivery and resale (wholesale) through their own distribution systems and meters must make written request to the City and Trust for such purchase of water. If said request is approved by the Council of the City and trustees of the Trust, the outside City customer shall enter into a contract with the City and the Trust for the purchase of such water and water service. The City and/or Trust contracts directly with outside City customers and each customer commits to pay monthly water customer service charge(s) and to pay for the water and water service from the City throughout the term of the customer's account as provided in this Code. This Code and any written agreement with the City and the Trust shall be deemed the contract between the City and customers receiving water or water services from the City water system. All inside City and outside City, retail and wholesale, water and water service customers must comply with water conservation directives and ordinances as provided in this Code. Any contract or renewal or extension of existing contracts for water or water service from the water system of the City shall include a provision requiring the customer to commit to one of the following water service levels, and any revision, amendment, or addition thereto: (1) Treated Water, Outside City, Oklahoma City water source, retail residential service (Incorporated and Unincorporated) (Single Family, Duplex and Triplex). (The unincorporated retail rate is lower than the incorporated retail rate, which also includes a 2% payment in lieu of taxes (PILOT) cost paid to the other city) and non-dedicated private fire service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (2) Treated Water, Outside City, Oklahoma City water source, retail non-residential service (Incorporated and Unincorporated) (Multifamily). (The unincorporated retail rate is lower than the incorporated retail rate, which also includes a 2% payment in lieu of taxes (PILOT) cost paid to the other city) and non-dedicated private fire service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (3) Treated Water, Outside City, Oklahoma City water source, retail non-residential service (Incorporated and Unincorporated)(Commercial/Industrial). (The unincorporated retail rate is lower than the incorporated retail rate, which also includes a 2% payment in lieu of taxes (PILOT) cost paid to the other city) and non-dedicated private fire service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (4) Treated Water, Outside City, Oklahoma City water source, retail service (Incorporated and Unincorporated) (Irrigation only). (The unincorporated retail rate is lower than the incorporated retail rate, which also includes a 2% payment in lieu of taxes (PILOT) cost paid to the other city) and non-dedicated private fire service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (5) Treated Water, Outside City, Oklahoma City water source, retail service (Incorporated and Unincorporated) (Flush Meter). (The unincorporated retail rate is lower than the incorporated retail rate, which also includes a 2% payment in lieu of taxes (PILOT) cost paid to the other city) and non-dedicated private fire service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code times the applicable rate in Chapter 60, the General Schedule of Fees) at the rates in accordance with the rate schedules for that customer class. (c) Treated Water, Outside City, Oklahoma City water source, wholesale, service availability. These customers will be charged and must pay a monthly water customer service charge(s), plus the subscribed monthly (applied daily if agreed by the wholesale customer) capacity reservation charge(s), regardless of use or nonuse of water, plus the commodity usage charge(s) for the water quantities provided up to the subscribed monthly capacity reservation gallons at the subscribed monthly capacity reservation commodity charge rate, plus for additional water quantities beyond the subscribed monthly capacity reservation gallons at the excess rates in accordance with the rate schedules for that customer class at the applicable rates in Chapter 60, the General Schedule of Fees, plus all other charges and fees set forth in this Code. The subscribed monthly capacity reservation is the minimum monthly capacity reservation the customer has determined and agreed to be charged by contract; provided that to qualify for this rate the customer's subscribed monthly capacity reservation must be at least 90% of the customer's maximum historic monthly usage in gallons. Maximum historic monthly usage as used in this section shall mean the maximum historic usage of Oklahoma City water in gallons for any month regardless the rate or customer class at the time of usage, less and except as re-calculated by the Director in accordance with subsection (h) of Section 60-55-16. The maximum historic monthly usage shall be calculated and/or re-calculated upon the date designated by contract for establishing or amending the subscribed monthly capacity reservation gallons, but in no case later than the first day of May in any year. (d) Treated Water, Outside City, Oklahoma City water source, wholesale, take-or-pay service. These customers will be charged and must pay monthly water customer service charge(s) plus water charge(s) based on the sum of the subscribed monthly usage volume (which must be at least 20% of their historical maximum usage to qualify for this rate) times the applicable rate regardless of use or non-use plus the volume of water (established, measured or estimated) provided by the City in excess of the subscribed monthly usage at the applicable rate or rates times the applicable rate in Chapter 60, the General Schedule of Fees, plus all other charges and fees set forth in this Code. If the customer fails to provide the Director a subscribed monthly usage volume, then the Director will assign a subscribed monthly usage volume based upon the maximum monthly usage in the prior 12 months, measured or estimated, such that all water usage would have been equal to or less than two times the subscribed monthly usage. (e) Raw Water, Inside City, Oklahoma City Water Source (Draper, Overholser or Hefner) and other specially contracted raw water, retail and wholesale. (1) Raw Water, Inside City, Oklahoma City Water Source (Draper, Overholser or Hefner), Demand service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code or a contract approved by the City times the applicable rate in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. Raw water does not include recycled water from wastewater treatment plants. (2) Raw Water, Inside City, Oklahoma City Water Source (Draper, Overholser or Hefner), Wholesale, Service Availability service. These customers will be charged and must pay a monthly water customer service charge(s), plus the subscribed monthly (applied daily if agreed by the wholesale customer) capacity reservation charge(s), regardless of use or nonuse of water, plus the commodity usage charge(s) for the water quantities provided up to the subscribed monthly capacity reservation gallons at the subscribed monthly capacity reservation commodity charge rate, plus for additional water quantities beyond the subscribed monthly capacity reservation gallons at the excess rates in accordance with the rate schedules for that customer class at the applicable rates in Chapter 60, the General Schedule of Fees, plus all other charges and fees set forth in this Code. The subscribed monthly capacity reservation is the minimum monthly capacity reservation the customer has determined and agreed to be charged by contract; provided that to qualify for this rate the customer's subscribed monthly capacity reservation must be at least 90% of the customer's maximum historic monthly usage in gallons. Maximum historic monthly usage as used in this section shall mean the maximum historic usage of Oklahoma City water in gallons for any month regardless the rate or customer class at the time of usage, less and except as re-calculated by the Director in accordance with subsection (h) of Section 60-55-16. The maximum historic monthly usage shall be calculated and/or re-calculated upon the date designated by contract for establishing or amending the subscribed monthly capacity reservation gallons, but in no case later than the first day of May in any year. Raw water does not include recycled water from wastewater treatment plants. (3) Raw Water, Inside City, Oklahoma City Water Source (Draper, Overholser or Hefner), Wholesale, AWC Tiered service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code or a contract approved by the City times the applicable rates in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. Raw water does not include recycled water from wastewater treatment plants. (f) Raw Water, Outside City, McGee Creek Source, Wholesale, Participant. Participants are the participants listed in the McGee Creek Trust Indenture and persons or entities for whom a listed participant has provided a written assignment of its participant rights to the General Manager of the Trust. Customers will be charged and must pay for water at a rate per thousand and any portion thereof. (1) Raw Water, Outside City, McGee Creek Source, Demand service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code or a contract approved by the City times the applicable rate in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. Raw water does not include recycled water from wastewater treatment plants. (2) Raw Water, Outside City, McGee Creek Source, Wholesale, Service Availability service. These customers will be charged and must pay a monthly water customer service charge(s), plus the subscribed monthly (applied daily if agreed by the wholesale customer) capacity reservation charge(s), regardless of use or nonuse of water, plus the commodity usage charge(s) for the water quantities provided up to the subscribed monthly capacity reservation gallons at the subscribed monthly capacity reservation commodity charge rate, plus for additional water quantities beyond the subscribed monthly capacity reservation gallons at the excess rates in accordance with the rate schedules for that customer class at the applicable rates in Chapter 60, the General Schedule of Fees, plus all other charges and fees set forth in this Code. The subscribed monthly capacity reservation is the minimum monthly capacity reservation the customer has determined and agreed to be charged by contract; provided that to qualify for this rate the customer's subscribed monthly capacity reservation must be at least 90% of the customer's maximum historic monthly usage in gallons. Maximum historic monthly usage as used in this section shall mean the maximum historic usage of Oklahoma City water in gallons for any month regardless the rate or customer class at the time of usage, less and except as re-calculated by the Director in accordance with subsection (h) of Section 60-55-16. The maximum historic monthly usage shall be calculated and/or re-calculated upon the date designated by contract for establishing or amending the subscribed monthly capacity reservation gallons, but in no case later than the first day of May in any year. Raw water does not include recycled water from wastewater treatment plants. (g) Raw Water, Outside City, McGee Creek Source, Wholesale, Non-participant. Non-participants are any person or entity other than: (1) the participants listed in the McGee Creek Trust Indenture or (2) persons or entities for whom a listed participant has provided a written assignment of its participant rights to the General Manager of the Trust. Customers will be charged and must pay for water at a rate per thousand gallons and any portion thereof. (1) Raw Water, Outside City, McGee Creek Source, Non-participant Demand service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code or a contract approved by the City times the applicable rate in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. Raw water does not include recycled water from wastewater treatment plants. (2) Raw Water, Outside City, McGee Creek Source, Wholesale, Non-participant, Service Availability service. These customers will be charged and must pay a monthly water customer service charge(s), plus the subscribed monthly (applied daily if agreed by the wholesale customer) capacity reservation charge(s), regardless of use or nonuse of water, plus the commodity usage charge(s) for the water quantities provided up to the subscribed monthly capacity reservation gallons at the subscribed monthly capacity reservation commodity charge rate, plus for additional water quantities beyond the subscribed monthly capacity reservation gallons at the excess rates in accordance with the rate schedules for that customer class at the applicable rates in Chapter 60, the General Schedule of Fees, plus all other charges and fees set forth in this Code. The subscribed monthly capacity reservation is the minimum monthly capacity reservation the customer has determined and agreed to be charged by contract; provided that to qualify for this rate the customer's subscribed monthly capacity reservation must be at least 90% of the customer's maximum historic monthly usage in gallons. Maximum historic monthly usage as used in this section shall mean the maximum historic usage of Oklahoma City water in gallons for any month regardless the rate or customer class at the time of usage, less and except as re-calculated by the Director in accordance with subsection (h) of Section 60-55-16. The maximum historic monthly usage shall be calculated and/or re-calculated upon the date designated by contract for establishing or amending the subscribed monthly capacity reservation gallons, but in no case later than the first day of May in any year. Raw water does not include recycled water from wastewater treatment plants. (3) Raw Water, Outside City, McGee Creek Source, Wholesale, Non-participant, AWC Tiered service. These customers will be charged and must pay monthly water customer service charge(s) plus water usage charge(s) (volume used is measured or estimated pursuant to this Code or a contract approved by the City times the applicable rates in Chapter 60, the General Schedule of Fees), plus all other charges and fees set forth in this Code. Raw water does not include recycled water from wastewater treatment plants. (h) Authorization for utility service agreements and rates for customers receiving wholesale service from another entity and retail service from the City. The City may enter into agreements with other entities for such entities to provide wholesale water service and/or to provide wholesale wastewater service to the City for the purpose of enabling the City to provide water and/or wastewater service to customers within the City limits and enabling the City to provide retail service to said customers in conjunction with the wholesale service provider. The Director is authorized to establish separate inside City retail water service classes, rates and charges and separate inside City retail wastewater service classes, rates, and charges for customers whose service is connected, directly or indirectly, to wholesale service from another entity. Such separate retail service charges and rates must include a monthly customer service charge and rates sufficient to recover all current and future costs and expenses of the wholesale service and all current and future costs and expenses of the retail service as determined by the Director. Oklahoma City Municipal Code § 55-64 Fire hydrant charges - treated water usage.

§ 55-64. - Fire hydrant charges - treated water usage. These treated water users that connect to fire hydrants will be charged and must pay a monthly water customer service charge(s) plus water usage charge(s) (volume established, measured, contracted, or estimated pursuant to this Code) times the applicable rate for treated water from fire hydrants and all other charges and fees set forth in this Code. All City water from fire hydrants, other than by Utilities Department employees or flushing or water quality purposes or City Fire Department employees for fire protection, must be purchased from the City and must be measured by a flush meter obtained from and provided by the City, regardless of whether the fire hydrant is within the City limits of the City. There is hereby established charges for treated water obtained through fire hydrants established in Chapter 60, the General Schedule of Fees. (Code 1970, § 35-43(c); Ord. Oklahoma City Municipal Code § 55-65 Multiple meter usage charge.

§ 55-65. - Multiple meter usage charge. The consumption charge for such property or installation receiving water service shall be arrived at by totaling the consumption shown by each of the meters. (Code 1970, § 35-44; Code 1980, § 55-65; Ord. No. 19435, § 3, 6-26-90)

Oklahoma City Municipal Code § 55-66 Fire service.

§ 55-66. - Fire service. There is hereby levied charges for water service and water service availability on each fire service. Such charges shall be monthly water customer service charge(s) based on the size of such fire service and shall be due and payable monthly. Oklahoma City Municipal Code § 55-67 Meter setting charges.

§ 55-67. - Meter setting charges. There is hereby levied a schedule of charges for setting a meter on any service line. Such schedule may provide for an additional charge if special construction is required. Such schedule shall provide a separate inspection fee where a licensed plumbing contractor installs all or part of a water service except the meter in accordance with Section 55-39. Oklahoma City Municipal Code § 55-68 Inspection and re-inspection fees.

§ 55-68. - Inspection and re-inspection fees. There are hereby levied water service inspection fees for regular working hours and other than regular hours as defined in Subsection 55-40(c) above and re-inspection fees for regular working hours. Oklahoma City Municipal Code § 55-69 Water and sewer system development charges.

§ 55-69. - Water and sewer system development charges. (a) Assessment. Any person or entity which makes a water service connection to the Oklahoma City water system, and/or any person or entity which makes a sewer service connection to the Oklahoma City sanitary sewer system shall make an application, obtain all necessary permits, and pay system development charge(s) for each such connection, as hereinafter provided, prior to making such a connection. (b) Formulae. (1) the amount of the water system development charge(s), which shall be assessed for each water meter and water connection to the Oklahoma City water system shall be as established in this Code. The water system development charge(s) will be incurred and must be paid at the time of applying for plumbing permit or before making a water service connection, whichever comes first. The water system development charge for each meter or connection is the meter multiplier times the water system development charge rate as established in Chapter 60, the General Schedule of Fees. (2) the amount of the sanitary sewer system development charge(s), which shall be assessed for each sanitary sewer connection to the Oklahoma City sanitary sewer system shall be as established in this Code. (c) Credits. Whenever a connection to a particular premises or facility is replaced, the applicant or customer has the burden to provide sufficient information and verification to demonstrate that a credit is due and the amount of such credit. (d) Payment. (1) the water system development charge(s) to be paid by any person or entity applying for a plumbing permit or making a water service connection must be paid to the Oklahoma City Water Utilities Trust prior to and as a condition of the connection or reconnection to the Oklahoma City water system and prior to the customer's use of the Oklahoma City water system. (2) the sanitary sewer system development charge(s) to be paid by any person or entity applying for plumbing permit or making a sanitary sewer service connection must be paid to the Oklahoma City Water Utilities Trust prior to and as a condition of the connection or reconnection to the Oklahoma City sanitary sewer system and prior to the customer's use of the Oklahoma City sanitary sewer system. (e) Limitations on deposit and use of funds. (1) The trustees of the Oklahoma City Water Utilities Trust shall cause all funds collected hereunder for connection to the Oklahoma City water system to be deposited into the water system development charge account of the Oklahoma City Water Utilities Trust and the same shall be expended by said trustees only for new construction and improvements to the Oklahoma City water supply system. (2) The trustees of the Oklahoma City Water Utilities Trust shall cause all funds collected hereunder for connection to the Oklahoma City sanitary sewer system to be deposited into the sewer system development charge account of the Oklahoma City Water Utilities Trust and the same shall be expended by said trustees only for new construction and improvements to the City sanitary sewer supply system. (f) Definitions. The following words, terms and phrases, when used in this section, shall have the meanings ascribed to them below: (1) A water connection means and includes any tap or connection to the Oklahoma City water system for service or potential service to a premises and any increase in the size of a water service meter between a premises having existing water service and the Oklahoma City water system. (2) A sanitary sewer connection means and includes any tap or connection onto the Oklahoma City sanitary sewer system for service or potential service to a premises and any increase in the capability for discharge to the Oklahoma City sanitary sewer system by increasing the size or number of the water connections to the Oklahoma City water system or by increasing the size or number of the sanitary sewer connections to the Oklahoma City sanitary sewer system or through the increase in water service to or sewer service from the premises from another source. (3) System development charges hereunder were formally referred to as system impact fees or charges and are sometimes referred to as impact fees. (Ord. Oklahoma City Municipal Code § 55-70 Adjustments in usage charges due to reading errors, leaks, etc.

§ 55-70. - Adjustments in usage charges due to reading errors, leaks, etc. (a) In any case where there appears to be a gross discrepancy in the amount of apparent water consumption, an inspector from the Utility Customer Services Division may, upon request of the customer within 30 days from the date the bill is rendered, verify and inspect the reading of the meter. In the event that the meter was misread or a billing error was made, the error will be corrected. In cases of an increase in a consumer's water bill resulting from a hidden or underground water leak, exclusive of faucet or toilet leaks, of which the consumer was unaware, and which could not have been reasonably detected by him, or in the case of burst pipes, an adjustment of such account may be allowed by the utilities superintendent if the leak has been repaired and either a statement submitted to the utilities superintendent reflecting said repair or an affidavit signed by the consumer attesting to this fact is presented to the utilities superintendent. (b) Upon presentation of the above documentation, an adjustment may be allowed to the extent that the consumer shall pay for his average water consumption at the regular rate. As used in this section the term "average water consumption" shall mean the average consumption of the two previous readings, or if this data is unavailable or does not represent a reasonable average for the consumer, the average consumption of the two subsequent readings or the average consumption from a comparable time period prior to the leak as determined by the utilities superintendent. (c) If, by determination of the City Manager or his designated representative, and after all reasonable avenues for explanations have been exhausted (i.e., verification of the meter reading, inspection for leaks, meter condition, meter test), the apparent water consumption for a period not to exceed two months shall be excessive in that said consumption shall exceed by 150 percent the average water consumption as defined above and no reasonable explanation appears to exist to justify the exceptional billing, an adjustment to the customer's account may be made if: (1) the customer shall submit to the City Manager or designated representative an affidavit attesting that he did not consume an excessive amount of water during the billing period in question; and (2) the customer shall submit to the City Manager or designated representative a statement stating that upon examination of the premises in question no leaks or other causes for the apparent excessive water consumption were found. Upon presentation of the above documentation, an adjustment may be allowed to the extent that the consumer shall pay for his average water consumption at the customer's regular rate. (d) In the event a consumer is granted an adjustment to his water bill under this section, and if his sanitary sewer rates are based on his water consumption, an adjustment for sanitary sewer service may be allowed; said adjustment shall be based on the consumer's revised water consumption billing. (e) An adjustment as described in Subsections (c) and (d) shall only be allowed once during any 15-month period for any given premises or location. (Code 1970, § 35-42; Code 1980, § 55-68; Ord. Oklahoma City Municipal Code § 55-71 Adjustments to charges and testing of meter when meter has been covered or obstructed.

§ 55-71. - Adjustments to charges and testing of meter when meter has been covered or obstructed. (a) When an Oklahoma City water meter has been covered or obstructed so as to prevent actual reading for more than two billing periods, the meter shall be inspected and, if necessary, tested for accuracy: (1) If accurate, the consumer shall be billed for the outstanding balance due on his account. Any outstanding balance owed by the consumer shall be payable in equal payments over a period of time equal to the period of time the meter was obstructed or covered unless the property owner, tenant or consumer, their agent or employee, shall have been determined by the Director of Utilities, or his designated representative, to be responsible for covering the meter. If it is determined that the property owner, tenant or consumer, their agent or employee, is responsible for obstructing or covering the meter, then any outstanding balance shall be due and payable at the time that the next bill for water service is due and payable. (2) if the meter is determined to be inaccurate, as defined by this Code, then the water charges shall be adjusted, based upon the information provided by the meter test, to more closely reflect actual consumption; and the meter replaced or repaired. (b) Should it be determined that said meter was covered by the City, the City Manager, or his designated representative, may, in his discretion, make an adjustment to the consumer's account not to exceed the amount of ¼ of the outstanding balance. (c) As utilized herein, "outstanding balance" shall mean the difference between the amount that has been billed during the period the meter was covered and the actual meter reading obtained at the time of uncovering. Oklahoma City Municipal Code § 55-72 Estimation of usage charges.

§ 55-72. - Estimation of usage charges. If a water meter is out of order or if the meter reader is unable to obtain a reading of the meter, water used at the premises shall be billed, pending the correction of the problem, on the basis of an estimate made by the utilities superintendent. The estimate may be based on the billing of water to the premises during the preceding billing period(s) or during the same billing period(s) of the preceding year, and other data considered by the utilities superintendent to be the most reliable at his command may be used in the determination of his estimate. (Code 1970, § 35-36; Ord. No. 17124, § 1, 4-12-83; Code 1980, § 55-70)

Oklahoma City Municipal Code § 55-73 Testing of meters.

§ 55-73. - Testing of meters. (a) If the accuracy of record of a water meter is questioned by the owner or occupant of premises served by the meter, he may request a test to be made. The request shall be accompanied by a deposit with the City Treasurer of the amount charged for the test, or the person requesting the test may authorize the addition thereof to his meter account, subject to the condition herein stated. (b) The meter may, at consumer's request, be removed and tested in the shops of the Utility Customer Services Division, and the consumer may be present when the test is made; provided, however, that no meter shall be removed or in any way disturbed nor the seal thereof broken except in the presence and under the direction of the utilities superintendent. (c) Findings resulting from the test shall be conclusive as to both the consumer and the Utility Customer Services Division. (d) If the test discloses an error of registration of more than three percent against the consumer: (1) the amount of the excess registration shall be imputed to the consumption as registered and shown by the three previous meter readings and shall be credited for the period to the consumer's meter account; (2) the Utility Customer Services Division shall bear the entire cost of the test and return to the consumer the full amount of his deposit made for the test. (e) If less than three percent error is found by the tests, the consumer requesting the test shall pay the test charge. (Code 1970, § 35-41; Code 1980, § 55-71)

Oklahoma City Municipal Code § 55-74 Failure to receive mail no excuse.

§ 55-74. - Failure to receive mail no excuse. Every water consumer, whether owner or tenant, shall keep the Utility Customer Services Division advised of the consumer's correct mailing address. The failure of any consumer to receive water bills shall not be a valid excuse for failure to pay the bills when due. (Code 1970, § 35-31; Code 1980, § 55-72)

Oklahoma City Municipal Code § 55-75 Service installation charges.

§ 55-75. - Service installation charges. (a) The charges for complete installation of water services, including meter box, inspection charge, and meter setting, from water mains shall be as established in Chapter 60, the General Schedule of Fees. (b) Where a licensed plumbing contractor installs all or part of the service except the meter, in accordance with Section 55-67, the service installation charge shall be the sum of the cost of the meter, the inspection charge, and the meter setting charge established in Section 55-67, plus the cost of any work done by the City, if any. Oklahoma City Municipal Code § 55-76 Water service tap fee.

§ 55-76. - Water service tap fee. The water service tap fee shall be payable to the City prior to connection with the City's water mains. The amount of the fee shall be determined in accord with Policy A of the Water Main Extension Policy for approach and boundary mains as approved by the City Council on November 8, 1977, and all amendments thereto. (Code 1970, § 20-134.1; Code 1980, § 55-74)

Oklahoma City Municipal Code § 55-77 Reading meters; billing.

§ 55-77. - Reading meters; billing. The utilities services superintendent shall schedule water meters to be read every other month and shall render water bills to water consumers every month. Whenever readings are not or cannot be obtained, the monthly billing shall be based on an estimate made in accordance with Section 55-72 of this article. (Code 1970, § 35-48; Ord. Oklahoma City Municipal Code § 55-78 Additional charge for delinquent bills.

§ 55-78. - Additional charge for delinquent bills. Any amount due on any utility account or on any utility bill issued by the City not paid by the due date shall be considered delinquent. An additional charge of one and one-half percent per month may be assessed for all delinquent amounts for so long as the amounts remain delinquent. These charges shall apply to all utility services provided by or billed by the City. (Code 1970, § 35-48; Ord. No. 17126, § 1, 4-12-83; Code 1980, § 55-76; Ord. No. 20315, § 1, 3-28-95)

Oklahoma City Municipal Code § 55-79 Termination of service for nonpayment.

§ 55-79. - Termination of service for nonpayment. (a) Nonpayment. In the event a utility bill is not paid within ten days after it becomes delinquent, the water service to the premises being served may be terminated. (b) Notice of termination. Such water service shall not be terminated unless notice has been posted that the service will be terminated. Such notice will consist of a written notice posted at least 48 hours prior to termination and again on the day of termination. Such notices shall also contain the telephone number of a City office where the owner or occupant may contact a customer service representative to discuss the bill and have an opportunity to be heard. Posting of written pre-termination notices will result in the addition of notice charges to the unpaid bill each time such notice is posted. (c) Service termination. Once the 48-hour notice has been posted and payment has not been made prior to the date of termination then water service may be terminated. (d) Re-start. If water service is to be reestablished a re-start charge will be added to the bill. (e) Payment of delinquent amounts due. If water service has been terminated for nonpayment of a utility bill, the water service shall not be turned on until the total amount of the bill, the notice charges and the re-start charge have been paid, or satisfactory arrangements for payment have been approved by the Customer Service Superintendent or designee. (f) Security deposit required. In addition, any customer, not maintaining a security deposit with the utilities, whose service(s) is or has been terminated for nonpayment, shall be required to make and maintain a security deposit in the amount required by Section 55-52 before water service shall be reestablished. Oklahoma City Municipal Code § 55-80 Additional and private meter authorization.

§ 55-80. - Additional and private meter authorization. (a) The Director is hereby authorized to permit customers to connect water and sanitary sewer meters to their private water system and/or private sanitary sewer system for the purpose of measuring usage and/or flow of potable water or sanitary sewerage. The Director shall prescribe the manner, type and location of such meters. A fee shall be established for reading such additional or private meters and administering these customer accounts. (b) The monthly customer service charge provide for the cost of one water meter per customer per location to measure water usage for water and/or sanitary sewer billing purposes. The customer may request and the Director may authorize additional meters to be installed on the private or public system to measure water or wastewater flow or usage upon which water or sewer bills will be issued. These additional or private meters include, but are not limited to, water meters, wastewater meters, recycled water meters, deduct meters, well meters, fire line meters, flush meters and any other approved device measuring water, wastewater, treated effluent or recycled water flow or usage for City utility billing purposes. (c) The customer shall pay a monthly meter charge for each additional or private meter read by the City used to measure potable water usage or sanitary sewer flow or usage for billing purposes. The monthly meter charge for each additional and each private meter shall be as established in Chapter 60, the General Schedule of Fees. (d) The intent of this section is that a monthly meter fee be charged for each and every individual meter or device that is utilized to establish usage or flow. Therefore, whenever multiple meters or devices used in combination or series, customers will be charged for each and every meter or device which is used as a basis for establishing utility billing. Oklahoma City Municipal Code § 55-81 After hours service calls.

§ 55-81. - After hours service calls. The utilities superintendent or designee schedules service calls on a first come first call basis. The charge for such services are set forth in this Code. Any customer who requests the performance of a service after regular business hours shall be charged and shall pay an additional charge per service call as set forth in Chapter 60, the General Schedule of Fees. For the purposes of this section, after hours service calls shall be those service calls scheduled for other than between 7:00 a.m. and 4:00 p.m. or on Saturdays, Sundays, or City holidays. The utilities superintendent is hereby authorized to waive the after hours service charge whenever in the utilities superintendent's discretion the service call is in response to an emergency not caused by the customer. Oklahoma City Municipal Code § 55-82 Mandatory water use restrictions and emergencies.

§ 55-82. - Mandatory water use restrictions and emergencies. (a) All accountholders and utility customers, as a requirement and condition of service and as a part of the contract for utility services with the City, must comply with all mandatory water use restrictions. Water use restrictions include, but are not limited to, one or more of the following: water use condition(s), limitation(s), rotation(s), ban(s), prohibition(s) and other water restriction(s) issued in accordance with this Code. (b) For any service address, should mandatory water use restrictions be issued in accordance with this Code, then all accountholders and customers using or receiving water service at such service address must immediately comply with the terms and conditions of said mandatory water use restriction. Compliance with mandatory water use restrictions is a condition of continued and continuous water service. Use of water at a service address in violation of a mandatory water use restriction by the accountholder or a customer shall be deemed to be a breach of the terms of the contract for utility services with the City and may also constitute an offense under this Code. The accountholder shall be responsible for all water use at the service address. (c) Should a mandatory water use restriction be issued in accordance with this Code, then all accountholders and customers must immediately comply with the terms and conditions of said mandatory water use restriction. Compliance with mandatory water use restrictions is a condition of continued and continuous water service. Use of water in violation of a mandatory water use restriction by the accountholder, a customer, the agent of the accountholder, or any person at or in the service address shall be deemed a breach of the terms of the contract for utility services with the City. The accountholder shall be responsible for all water use at the service address. (d) The City shall have the immediate right under the contract for utility services and under the police power to unilaterally restrict or suspend all City water services to any service address utilizing water in violation of a mandatory water use restriction. If the accountholder or customer has multiple water service lines with separate cut-off valves of which the City has been previously informed, then, if possible and immediately self-evident and ascertainable, the City will attempt to only suspend or restrict City water service through the service line or lines used to violate or in violation of the mandatory water use restrictions. Once physically restricted or suspended by the City, the water service may not be re-established except at the direction of the Utilities Superintendent in accordance with this Code. (e) Should water service be restricted or suspended pursuant to a mandatory water use restriction, the accountholder shall have seven calendar days from such restriction or suspension to request an administrative hearing before the Utilities Superintendent to review the water use restriction, the water use at the service address, the City's actions to enforce the terms of contract for utility services and shall hear testimony from the customer and from City staff. Upon timely request by the accountholder, the Utilities Superintendent will set an administrative hearing date and provide a hearing during regular business hours. This administrative hearing shall be limited to the issue of the accountholder or customer's breach of the contract for utility services and the fees charged pursuant thereto and not upon any citation which may have been issued for an offense involving these same facts or circumstances. Upon completion of the administrative hearing, the Utilities Superintendent may: (1) direct re-establishment of City water service, (2) direct re-establishment of City water service subject to certain conditions, restrictions, or limitations, (3) direct the continued restriction or suspension of City water service, and (4) determine whether the customer shall be charged the cost of restricting, suspending, or terminating water service and the cost of re-establishing water service or conditional or limited water service as set forth in Chapter 60, the General Schedule of Fees. Restriction or suspension of water service to the service address shall not relieve the accountholder of any obligation to timely pay utility fees and charges. The Utilities Superintendent, in her or his discretion, shall have the authority to re-establish City water service or re-establish conditional or limited water service prior to or without an administrative hearing. The Utilities Superintendent shall have the authority to determine whether to charge the accountholder the cost of restricting, suspending, or terminating water service and the cost of re-establishing water service or conditional or limited water service as set forth in Chapter 60, the General Schedule of Fees. Any such action or actions by the Utilities Superintendent prior to the administrative hearing shall be as a courtesy to the accountholder or customer and without prejudice to the determination of the hearing on the condition, restriction, limitation, or suspension of water service or the ability of the City to charge the accountholder for the cost of restricting, suspending, or terminating water service and the cost of re-establishing water service or conditional or limited water service as set forth in Chapter 60, the General Schedule of Fees. (f) Should the Utilities Superintendent determine that the accountholder or a customer breached the contract for utility services by failing to comply with a water use restriction mandate or directive issued pursuant to Chapter 57, then the accountholder shall bear the cost of restricting, suspending, or terminating water service and the cost of re-establishing water service or conditional or limited water service as set forth in Chapter 60, the General Schedule of Fees. The aforementioned fees shall be a contractual obligation and charge separate and distinct from any potential fine for violation of water use restrictions. The accountholder will be responsible for any loss, expenses, or damages to the accountholder, a customer, occupants, and water users at the service address and to the equipment, plumbing, fixtures, and real and personal property at the service address resulting from the restriction or suspension of City water service for breach of the contract for utility services by violation of a mandatory water use restriction. (g) All accountholders and utility customers, as a requirement of service and a condition of the contract for utility services, agree that should the City Manager or designee determine that a condition exists which causes or will cause an imminent danger or risk to the public health, safety, or welfare, the City Manager or designee may declare an emergency specifically referencing this subsection of the Code and direct the Director, pursuant to the City's police powers and the City's contractual rights established hereby, to immediately temporarily restrict or suspend water service or water use to any service address, accountholder, or customer. This subsection is separate and distinct from a water use restriction by mandate or directive pursuant to Chapter 57. The Utilities Department will use reasonable efforts under said existing conditions to notify an occupant present at the service address of the emergency and the City's action and the conditions, requirements, manner and timing under which water service or limited water service may be restored. The accountholder shall not be charged by the City for any cost of restricting, suspending, terminating, or re-establishing water service or limited water service following an emergency declaration restriction or suspension of water service solely pursuant to this subsection. (h) Hereinafter as part of the installation of every irrigation system, the accountholder or utility customer shall install or cause to be installed a separate cut off valve for irrigation systems in the City right-of-way or easement so that water use through the irrigation systems may be turned off independent of and without terminating water service for other uses. In addition, as part of the maintenance or replacement of the connection between the water service line and an existing irrigation system, the accountholder or utility customer shall install or cause to be installed a separate cut off valve for irrigation system so that water use through the irrigation system may be turned off independent of and without terminating water service for other uses. As part of the contract for utilities services, the City is granted the right to enter the accountholder's property and suspend water service to any irrigation systems whenever such water use is restricted or deemed to be restricted in accordance with this section. Oklahoma City Municipal Code § 55-83 Housekeeping unit charges.

§ 55-83. - Housekeeping unit charges. A monthly housekeeping unit charge shall be charged to and must be paid for each housekeeping unit by each nonresidential account holder as defined in Section 55-62 of this Code. The monthly charge per housekeeping units shall be the sum of the number of housekeeping units served and the number of housekeeping unit capable of being served by the same meter times the housekeeping unit charge rate. The schedule of such charges shall be as established in Chapter 60, the General Schedule of Fees. (Ord. No. 24966, § 3, 9-9-14)

Oklahoma City Municipal Code § 55-84 Termination of City water service for nonpayment of wastewater service charges.

§ 55-84. - Termination of City water service for nonpayment of wastewater service charges. The City hereby adopts this program to implement Oklahoma Statutes, Title 11, Article XXII, Section 22-112.5. (a) Should the governing body of a public entity providing sewer or waste water service to real property find the sewer or waste water account for the property to be delinquent as determined by the policies adopted by the public entity regarding nonpayment, then the public entity may request the City terminate water service to the property as follows: (1) The governing body of the public entity providing sewer or waste water service to property must adopt a resolution stating and affirming: a. notice and hearing procedures have been enacted to ensure the account holder(s) and the property owner(s) of the property receive notice and an opportunity for hearing prior to the issuance of a request to the City for termination of water service for nonpayment of sewer or waste water service provided by the public entity; and b. the account holder(s) and the property owner(s) of the property were provided notice by certified mail, return receipt requested and provided an opportunity for a hearing regarding the nonpayment of sewer or waste water service to the property; and c. the account holder(s) and the property owner(s) of the property had received notice and had an opportunity for a hearing regarding nonpayment of sewer or waste water service charges for the property; and d. the sewer or waste water account for the property was found by the governing body of the public entity providing sewer or waste water service to the property to be delinquent as determined by the policies adopted by the public entity regarding nonpayment; and e. directing the notice of the determination of delinquency by the governing body of the public entity providing sewer or waste water service to the property be sent by the public entity to the account holder(s) and property owner(s) of the property via US Postal Service first-class mail; and f. setting the proposed date for water service termination, which must be at least 30 days after the notice of determination of delinquency by the governing body of the public entity providing sewer or waste water to the property will have been sent via US Postal Service first-class mail to the account holder(s) and the property owner(s) of the property and via US Postal Service first-class mail to the City or such other delivery system mutually agreed by the City and the public entity. (2) The governing body of the public entity providing sewer or waste water service to the property will attach to and incorporate by reference in the resolution: a. A link to or a certified copy of the notice and hearing procedures enacted by the governing body of the public entity providing sewer or waste water service to the property by which the account holder(s) and the property owner(s) of the property were provided notice and an opportunity for hearing prior to the issuance by the public entity providing sewer or waste water service to the property of a request to the City for water service termination; and b. A copy of the record of the County Assessor and a copy of the record of the County Treasurer indicating the name(s) and address(es) of the property owner(s) of the property at the time notice was provided; and c. A signed and notarized affidavit with a sworn statement by a representative of the public entity providing sewer or waste water service to the property knowledgeable of the relevant and pertinent records and procedures stating and affirming: 1. the name(s) and the sewer or waste water service address(es) and the mailing address(es) of the sewer or waste water service account holder(s) for the property; and 2. notice of delinquency and of an opportunity for hearing was received by the account holder(s) and the property owner(s) of the property, in accordance with the notice and hearing procedures enacted by the governing body of the public entity providing sewer or waste water service to the property, prior to the commencement of the procedures pursuant to which the governing body of public entity providing sewer or waste water service to the property determined delinquency and requested termination of water service; and 3. whether the account holder(s) or the property owner(s) of the property requested a hearing, and, if so, when it was held; and (3) In addition, with the resolution adopted by the governing body of the public entity providing sewer or waste water service to the property requesting termination of water service by the City in this Subsection (a), and the attachments thereto, the public entity will provide the City a signed and notarized affidavit with a sworn statement by a representative of the public entity knowledgeable of the relevant and pertinent records and procedures stating and affirming: a. the proposed date for termination of water service by the City; and b. notice of the proposed date for water service termination at the property was provided via US Postal Service first-class mail to the account holder(s) and the property owner(s) of the property by the governing body of the public entity providing sewer or waste water service to the property, in accordance with the notice and hearing procedures enacted by the governing body of the public entity, at least 30 days prior to the proposed date for termination of water service by the City. (b) Upon receipt by the City of the resolution adopted by the governing body of the public entity providing sewer or waste water service to the property requesting termination of water service by the City as provided in Subsection (a)(1) and (2), with attachments, and the affidavit as provided in Subsection (a)(3), the City will: (1) issue a notice of water service termination to its water service account holder by certified mail, return receipt requested; and (2) provide its water account holder an opportunity for a hearing regarding the termination of water service; and (3) terminate water service to the property on the proposed date for termination or within 30 days thereafter, unless prior to termination of water service the City receives notice of resolution of the delinquency from the public entity providing sewer or waste water service to the property. (c) Should the water service account holder(s) request a hearing with the City regarding the termination of water service, the City will provide the requesting water service account holder(s) with an opportunity for a hearing. Should the requesting water service account holder(s) fail to attend the hearing on the termination of water service or should the City determine as a result of a hearing on termination of water service that the public entity providing sewer or waste water service to the property satisfied the statutory requirements, then the City will terminate water service to the property on the proposed date for termination or within 30 days thereafter. (d) Should the water service account holder(s) request a hearing with the City regarding the termination of water service to the property, then pursuant to the hearing the City may, in its discretion, delay termination of water service to the property for up to 30 days from the proposed date for termination of water service to give the water service account holder(s) an opportunity to request a hearing with the public entity providing sewer or waste water service to the property and to resolve the delinquency with the public entity providing sewer or waste water service to the property. (e) Subsequent to termination of water service to the property for nonpayment of sewer or waste water service, should the City receive notice of resolution of delinquency from the public entity providing sewer or waste water service to the property, then the City will renew water service to the property no later than the first business day following receipt of notice from the public entity providing sewer or waste water service to the property. (f) Should the City terminate water service or, after termination of water service, re-start water service, the City shall charge its water service account holder(s) for applicable water service termination and water service re-start as established in Chapter 60, the General Schedule of Fees. (g) Notices to account holder(s) and property owner(s) sent by US Postal Service first-class mail will be deemed received on the date deposited with the United States Postal Service. Notices sent to account holder(s) and property owner(s) by electronic mail, if provided in procedures adopted by the public entity providing service, will be deemed received on the date an electronic notice of delivery is received by the sender. (h) Notices to the City or the public entity providing service sent by US Postal Service first-class mail will be deemed received on the date received by the City or public entity, respectively. The City and public entity may mutually establish procedures for electronic notices. Notices sent to the City or the public entity by electronic mail will be deemed received on the date an electronic notice of delivery is received by the sender. The City and public entity will mutually establish addresses for sending and receiving notices under this procedure for termination of water service for nonpayment of sewer or waste water services in this Section. (i) Account holder(s) are responsible for providing to the public entity address(es) for mailing by United States Postal Service and by electronic mailing, if provided in procedures adopted by the public entity providing service, and is responsible for updating address(es) as same may change, so the public entity may provide the account holder(s) notices about service, billing, and termination of services. Account holder(s) will be responsible for providing to the City address(es) for mailing by United States Postal Service and electronic mailing, if provided in procedures adopted by the City, and is responsible for updating address(es) as same may change, so the public entity may provide notices about service, billing, and termination of services. (j) Property owner(s) are responsible for providing and updating the records of the County Assessor and the County Treasurer with accurate address(es). (k) Additionally, account holder(s) accept the responsibility for providing address(es) to the City and updating address(es) with the City as a requirement of the contract for water service. (l) As used in this Section, "waste water" will include sewer water, sewage, waste water and wastewater as the terms are used elsewhere in this Code. (Ord. No. 25697, § 1, 8-15-17, eff. 9-14-17)

Oklahoma City Municipal Code § 55-85 Termination of water service for nonpayment of City wastewater service charges.

§ 55-85. - Termination of water service for nonpayment of City wastewater service charges. The City hereby adopts this program to implement Oklahoma Statutes, Title 11, Article XXII, Section 22-112.5. (a) Should the City Council, as the governing body of a public entity providing sewer or waste water service to real property find the sewer or waste water account for the property to be delinquent as determined by the policies adopted by the City regarding nonpayment, then the City may request the public entity providing water service to the property terminate water service to the property as follows: (1) The City will adopt a resolution stating and affirming: a. notice and hearing procedures have been enacted to ensure the account holder(s) and the property owner(s) of the property receive notice and an opportunity for hearing prior to the issuance of a request by the City for termination of water service for nonpayment of City sewer or waste water service; and b. the account holder(s) and the property owner(s) of the property were provided notice by certified mail, return receipt requested and provided an opportunity for a hearing regarding the nonpayment of sewer or waste water service to the property; and c. the account holder(s) and the property owner(s) of the property had received notice and had an opportunity for a hearing regarding nonpayment of sewer or waste water service charges for the property; and d. the sewer or waste water account for the property was found by the City Council to be delinquent as determined by the policies adopted by the City regarding nonpayment; and e. directing the notice of the determination of delinquency by the City Council be sent by the City to the account holder(s) and property owner(s) of the property via US Postal Service first-class mail; and f. setting the proposed date for water service termination, which must be at least 30 days after the notice of determination of delinquency by the City Council will have been sent via US Postal Service first-class mail to the account holder(s) and the property owner(s) of the property and via US Postal Service first-class mail to the public entity providing sewer or waste water service to the property or such other delivery system mutually agreed by the City and the public entity. (2) The City will attach to and incorporate by reference in the resolution: a. A link to or a certified copy of the notice and hearing procedures enacted by the City by which the account holder(s) and the property owner(s) of the property were provided notice and an opportunity for hearing prior to the issuance by the City of a request to the public entity for water service termination; and b. A copy of the record of the County Assessor and a copy of the record of the County Treasurer indicating the name(s) and address(es) of the property owner(s) of the property at the time notice was provided; and c. A signed and notarized affidavit with a sworn statement, by a representative of the City knowledgeable of the relevant and pertinent records and procedures stating and affirming: 1. the name(s) and the sewer or waste water service address(es) and the mailing address(es) of the sewer or waste water service account holder(s) for the property; and 2. notice of delinquency and of an opportunity for hearing was received by the account holder(s) and the property owner(s) of the property, in accordance with the notice and hearing procedures enacted by the City, prior to the commencement of the procedures pursuant to which the City Council determined delinquency and requested termination of water service; and 3. whether the account holder(s) or the property owner(s) of the property requested a hearing, and, if so, when it was held; and (3) In addition, with the resolution adopted by the City Council requesting termination of water service by the public entity providing water service to the property in this Subsection (a), and the attachments thereto, the City will provide the public entity providing water service a signed and notarized affidavit with a sworn statement by a representative of the City knowledgeable of the relevant and pertinent records and procedures stating and affirming: a. the proposed date for termination of water service by the public entity providing water service; and b. notice of the proposed date for water service termination at the property was provided via US Postal Service first-class mail to the account holder(s) and the property owner(s) of the property by the City, in accordance with the notice and hearing procedures enacted by the City Council, at least 30 days prior to the proposed date for termination of water service by the public entity providing water service to the property. (b) Upon receipt by the public entity providing water service to the property of the resolution adopted by the City Council as provided in Subsection (a)(1) and (2), with attachments, and the affidavit as provided in Subsection (a)(3), the public entity providing water service to the property will: (1) issue a notice of water service termination to its water service account holder(s); and (2) provide its water account holder an opportunity for a hearing regarding the termination of water service; and (3) terminate water service to the property on the proposed date for termination or within 30 days thereafter, unless prior to termination of water service the public entity providing water service to the property receives notice of resolution of the delinquency from the City. (c) Subsequent to the City's request for the public entity providing water service to the property to terminate water service for nonpayment of sewer or waste water service, should the account holder(s) or property owner(s) resolve the delinquency and should the City receive payment, then the City will provide notice to the public entity providing water service and the sewer or waste water service account holder(s) and the property owners(s) of the property, no later than the first business day following receipt of the payment. Then, no later than the first business day following receipt of the notice by the public entity providing water service to the property from the City, the public entity will: (1) suspend termination of water service to the property, or (2) if water service to the property has been terminated, the public entity will renew water service to the property. (d) Should the City request the public entity providing water service to the property to terminate water service, the City shall assess the sewer or waste water service account holder(s) for applicable termination charges and administrative fees as established in Chapter 60, the General Schedule of Fees. Payment of any such charges and fees by the sewer or waste water account holder(s) are requirements included in the satisfaction of the delinquency. (e) Notices to the City or the public entity providing service sent by US Postal Service first-class mail will be deemed received on the date received by the City or public entity, respectively. The City and public entity may mutually establish procedures for electronic notices. Notices sent to the City or public entity by electronic mail will be deemed received on the date an electronic notice of delivery is received by the sender. The City and public entity will mutually establish addresses for sending and receiving notices under this procedure for termination of water service for nonpayment of sewer or waste water services in this Section. (f) Notices to account holder(s) and property owner(s) sent by US Postal Service first-class mail will be deemed received on the date deposited with the United States Postal Service. Notices sent to account holder(s) and property owner(s) by electronic mail, if provided in procedures adopted by the public entity providing service, will be deemed received on the date an electronic notice of delivery is received by the sender. (g) Account holder(s) are responsible for providing to the public entity address(es) for mailing by United States Postal Service and by electronic mailing, if provided in procedures adopted by the public entity providing service, and is responsible for updating address(es) as same may change, so the public entity may provide the account holder(s) notices about service, billing, and termination of services. Account holder(s) will be responsible for providing to the City address(es) for mailing by United States Postal Service and electronic mailing, if provided in procedures adopted by the City, and is responsible for updating address(es) as same may change, so the public entity may provide notices about service, billing, and termination of services. (h) Property owner(s) are responsible for providing and updating the records of the County Assessor and the County Treasurer with accurate address(es). (i) Sewer or waste water account holder(s) acknowledge and agree that bills and delinquency notices from the sewer or waste water service provider are and will be deemed notice of potential termination of water service for nonpayment of sewer or waste water service and that account holder(s) have the opportunity for a hearing, upon timely request, for a hearing regarding termination of water service. (j) Additionally, account holder(s) accept the responsibility for providing address(es) to the City and updating address(es) with the City as a requirement of the contract for sewer or waste water service. (k) As used in this section, "waste water" will include sewer water, sewage, waste water and wastewater as the terms are used elsewhere in this Code. (Ord. No. 25697, § 1, 8-15-17, eff. 9-14-17)
